<br />EXHIBIT A - Legal Desciption <br />A portion of the NW 1/4 of the NW 1/4 of Section 19, T6N, R43W of the <br />6th P.M. in Phillips County, Colorado. Said pit covers approximately 9.9 <br />acres. <br />EXHIBIT B - Mining Plan <br />Access to the pit area is currently available from Phillips County Road <br />numbers 49 and 8. A trail across the north side of Section 19 will be used <br />to access the pit area. This trail will not be improved, but simply used as <br />it exists. The trail will be left in place when the pit is closed as it is <br />used to check livestock. <br />Clay will be mined from the area as it is needed for local projects and <br />road operations and as the supply remains available. Clay could be mined up <br />to 20 feet in depth. <br />The pit area will primarily be aligned north and south. The area to be <br />mined will be stripped. The existing topsoil is about 4 inches deep. This <br />topsoil will be stockpiled at the side of the pit area for later use in <br />reclamation. <br />Stockpiling of the clay, for the most part, will not occur, as most of <br />the clay will simply be used as it is mined. If 'it is stockpiled, it will be ~' <br />done in one side of the pit area where excavation has already occured. <br />The pit will be operated annually. The supply is undetermined, but it <br />is expected to last an indefinite time because of the limited use of the pit. <br />The equipment to be used in the pit can include a dozer, front end <br />loader, scraper, and trucks. <br />
