<br />OCT-25-94 TUE 14.21 <br /> <br />P. 03 <br />Pnga 2 <br />We would like to bring to your attention species which are candidates for <br />official listing as tlir•eatened or endangered species (Federal e i r, Vol. <br />56, No. 225, November 21. 1991). While these species presently have na legal <br />protection under tl~e Endanyer•ed Species Act (Act), it is within the spirit of <br />the Act to consider project impacts to potentially sensitive candidate <br />species. Additionally, we wiai~ to make you aware of the presence of Federal <br />candidates should any be proposed or listed prior to the time that all Federal <br />actions related to the project are completed. <br />FEDERAL CANDIDATE SPECIES <br />Flannelmouth sucker <br />Roundtail chub <br />colo:ado kvr cutthroat <br />trout <br />ferruginous hawk <br />Habenarla zothecina <br />tatostanous Iatipinnis <br />Gila robusta <br />Oneorhynchus_ciarKf <br />pieuriticus <br />8uteo regalis <br />Alcove bog orchid <br />Be advised that the Fish and Wildlife Service can enter into formal section 7 <br />consultation only with another t•ederal agency ar its designee. Thus, this is <br />not to be considered an "official species list' but rather informal <br />consultation. Informal consultation includes all contacts, discussions, <br />correspondence, etc. between the Federal agency or its designated nonfederal <br />representative, and the Service, that take place prior to the initiation of <br />any necessary formal consultation. If requested, we will submit an official <br />list to the lead Federal agency. That agency will be required under section <br />(a) (2) of the Act to initiate formal consultation if it determines that its <br />action nay affect any listed species or its critical habitat. Although an <br />applicant maY fill the role of nonfederal representative the ultimate <br />responsibility for compliance with section 7 remains wit~i the Federal agency. <br />We recommend you also contact the Colorado Division of Wildlife regarding <br />possible impacts to resident species of fish and wildlife. In addition, the <br />project impact area should be inventoried for wetlands.
