LEASE
THIS LEASE is made and entered into this ;_~ day
of /;,:.~ 1981, 6y and between Anchor Coal Company, a
Colorado corporation ("Lessor") and Bear Coal Company, a
Colorado corporation ("Lessee");

1. Lessor, for and in consideration of the covenants
and payments provided herein, does hereby let, lease and demise
un to.,Lessee that certain real property situate in Gunnison
County, Colorado and more particularly described in Attachment/%
1 hereto, plus all improvements, easements, water rights and /
bridge rights thereon or appurtenant thereto (hereinafter
collectively described as "the Leased Premises").
• ~ 2. Commencing on the date hereof and annually
thereafter while this Lease is in effect, Lessee shall pay
Lessor a rental of $100 per year.
3. Commencing one year from the date hereof, or at
such time as Lessee occupies one or more of the buildings on
the Leased Premises, whichever is earlier, and annually
thereafter while this Lease is in effect, Lessee shall pay
Lessor an additional rental of $100 per year.
4. Lessee shall not be entitled to any refund of
rentals upon termination of this Lease.
5. This Lease shall remain in effect for so long as
the Sublease of the Onited States Coal Lease, executed this
same day between Lessor and Lessee, remains in effect.
6. Lessee agrees to maintain the Leased Premises in
good order and condition, normal wear and tear excepted.
. 7. This Lease may not be subleased or assigned
without Lessor's prior written consent, unless such sublease or
* (including all water and water rights, ditches and ditch rights,
wells and well rights, and reservoirs and reservoir rights
