Article 11 - Right of Insoectton by Anr_hor Anchor, its agents, engineers, or other persons in its behalf, shall at their own risk and expense and with prior notification to Bear, have the right and privilege of entering the works and mines of Bear in, upon or beneath the surface of the Property, accompanied by a representative of Bear, in order to inspect, examine, survey or measure the same or any part thereof and, for these purposes, using freely the means of access to the said works and mines taithout hindrance or molesta tioa. Article 12 - Taxes Seat shall pay all ad valorem and oche[ taxes and assessments (exclusive of Income or Excess Profits taxes of • Anchor or taxes paid on royalties received) that may be levied or assessed, du[ing the term hereof, against the Property and the subleased coal, or Bear's improvements thereon, or the coal mined therefrom, or the severance, processing, transportation or sale of said coal, or the products manufactured from said coal; and if any taxes and assessments are paid by Anchor, then Bear shall repay to Anchor the amount thereof. Either Anchor or Bear may protest or appeal the amount of such taxes and all expenses thereof shall be borne by the party protesting or appealing; however, such other party shall cooperate with the appealing or protesting party. Bear shall submit to Anchor evidence of the payment of said taxes. Anchor shall submit to Bear, promptly l1DOR receipt, copies of all tax notices or assessments affecting the Property.
