Cohen addressed the Board in summary and asked that this Permit not <br />be approved until water rights have been established or if approved, to <br />add a condition to the Permit to preclude Battle tlountain from going <br />forward with anything other a planning phase (there would be no <br />physical disturbance of the land), until all other requirements of the <br />statute have been satisfied. He also asked that CCCES be given an <br />opportunity to see a draft of the Permit, before it is issued. The <br />Board concurred that this would be possible. <br />It was MOYED that the Board approve the Permit including the Bond <br />amount X53,300,300 for both Phases of mining, as specified by Staff, <br />with the following finding and stipulations. Finding: TF~e proposed <br />mining and reclamation plans will minimally impact the hydrologic <br />balance. Stipulations: 1) the Operator must obtain the legally <br />recognized right to use water, prior to any actual leaching and <br />processing of ore and any required changes in points of diversion, <br />augmentation plans, etc., and submits those to the Division for filing; <br />2) the Operator must submit, to the Staff, a plan for secure storage of <br />cyanide flow bins for approval, prior to the construction of the <br />cyanide storage facility; 3) the Operator will provide Quarterly <br />reporting to the Division of the inflow of water into the pit (after <br />deveiopment of the pit has begun); 4) there will be monthly, mailed-in <br />reporting of the ground water monitoring data from the monitoring wells <br />in the vicinity of the heap leach pad.
