Cohen addressed the Board in summary and asked that this Permit not be approved until water rights have been established or if approved, to add a condition to the Permit to preclude Battle tlountain from going forward with anything other a planning phase (there would be no physical disturbance of the land), until all other requirements of the statute have been satisfied. He also asked that CCCES be given an opportunity to see a draft of the Permit, before it is issued. The Board concurred that this would be possible. It was MOYED that the Board approve the Permit including the Bond amount X53,300,300 for both Phases of mining, as specified by Staff, with the following finding and stipulations. Finding: TF~e proposed mining and reclamation plans will minimally impact the hydrologic balance. Stipulations: 1) the Operator must obtain the legally recognized right to use water, prior to any actual leaching and processing of ore and any required changes in points of diversion, augmentation plans, etc., and submits those to the Division for filing; 2) the Operator must submit, to the Staff, a plan for secure storage of cyanide flow bins for approval, prior to the construction of the cyanide storage facility; 3) the Operator will provide Quarterly reporting to the Division of the inflow of water into the pit (after deveiopment of the pit has begun); 4) there will be monthly, mailed-in reporting of the ground water monitoring data from the monitoring wells in the vicinity of the heap leach pad.
