<br />Minutes, ilarch 22-23, 1989 PACE 13 <br />The Board entertained discussion of hazardous xaste (barrels) on the <br />site and in San Luis, specifically, whether these were disposed of in <br />an appropriate manner. The flow bins containing the cyanide, which <br />will be used on site, are certified by the U.S. Department of <br />Transportation. <br />Ms. Baldrige, who developed Battle Mountain's Emergency Response Plan, <br />addressed issues raised by the CCCES in their Points of Authority <br />Memorandum and answered questions from the Board. In doing so, she <br />referred to Battle Mountain's February, 15, 1989, Adequacy Letter, <br />htr. Massey delivered concluding remarks, at this time, anci reserved the <br />right to respond to the next presentation by CCCES. <br />At this time, Mr. Neal Cohen asked questions of Battle Mountain <br />representatives; Ms. Baldrige, regarding humidity cell tescts, and Mr. <br />Dodson, regarding Battle Mountain's plan to proceed, after being <br />permitted. Mr. Cohen 's argument related to the sequencincp of permits, <br />specifically, as this deals with water rights. Mr. Massey and Ms. <br />Baldrige addressed the issues of water rights and usage. Performance <br />Standards were discussed. <br />Mr. Frank Johnson clarified the issue of the Board's jurisdiction, <br />referencing Page 37 of the Board's Rules. <br />In response to a question from the Board, Mr. John Halepaska identified <br />principal physical water supplies available in the area as Sanchez and <br />the Trinchera Irrigation Company. <br />Staff clarified that its initial approach to the water rights issue, <br />after reviewing the Application and discussion with the company, was <br />that disturbance to the hydrologic balance would be minimal. The <br />slurry wall and aquifer were discussed with the canpany. <br />Mr. Mike Entz, Board Member, acknowledged that he would not vote on <br />this issue today and addressed the Board regarding his concerns with <br />the Battle Mountain reclamation plan. <br />Mr. Jce Espinoza, Mayor of San Luis, addressed the Board. He <br />recommended the Board approve Battle Mountain's Permit Application, <br />commenting that he had received favorable reviews from Battle <br />Mountain's Nevada operation. Mr. Espinoza said he believed the <br />community's main objection with this operation stems from the proposed <br />location of the leach pad (he said he felt this problem could be <br />resolved). <br />Staff addressed the Board to clarify that, regarding the technical <br />aspects of the Application, e.g., topsoil, Staff did make independent <br />analysis and conducted a literature search which brought tnem to the <br />conclusion that the Application is in compliance with the MLR Act. <br />Mr. Massey delivered his summation and requested the Board approve the <br />Permit today. <br />
