COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENV/RONMEM', Water Quality Control Division <br />Ratiowle -Page 8, Permit No. CO-0045161 <br />Applicantsforreissuanceofapermitneedonlyprovideanyrelevantinformationonchangedcircums[antes,concerning <br />' the enformatron itemized above. <br />The Salinity Study requirements will be set forth as part afa compliance schedule. During the study, the facility_ will <br />continue to monitor for total dissolved solids on a quarterly basis. Samples shall be taken at all authorized a uent <br />discharge points. <br />g) Whole Effluent Toxicity (WET) Testin : No discharges from this facility are subject fo WET testing requirements (as <br />stated in a letter by the ivision tot a permittee on November 29, 1998). <br />Surface runoffoutfalls (OOIA, 002A, 003A, 004A, OOSA, 006A, 007A, 008A, 009A, OIOA) are exempted because: <br />i) Iron is the primary constituent with the potential for toxicity in the facility surface runo}fdischarges. Iron is much <br />less toxic than other metals -the toxicity level for aquatic Itfe is much higher for iron; <br />ii) Contact time is short; little time is available for oxidation to sign~cantly increase the concentration of iron in a <br />discharge; <br />iii) Surface runoffdischarges are expected to occur when stream flows are high and instream quality is deteriorated by <br />non-point source pollution and othersources. Temperatures ojsurface runo (especial[ysnowmelt) are expected to <br />6e typically lower than the temperature of mine drainage and pit water. This would slow oxidation. <br />Ifspecific information is received in thefuture that indicates the discharge has reasonable potential to cause toxicity to <br />aquatic Ztfe, the Division can reopen the permit as necessary to add WET requirements. <br />3. StormwaterEvaluation: Stormwaterdischargepennitsarerequiredforactiveandinactivecoalminingfacilifiesascovered <br />un er Stan and Industrial Classification (SIC) Code ]2. <br />Division records indicate that Co[owyo Coal Company, LP has coverageforstormwater dischargesfrom the Colowyo Coal <br />MineunderaGeneralS[ormwaterDischar,gqePermit,numberCOR-040209. Stormwaterpermittingissuesforthisminewill <br />6e handled separately by the Division's Stormwater Unit, although this permit may be reopened at a later date to <br />incorporate stormwater provisions, ijdeemed appropriate. <br />4. Economic Reasonableness Evaluation: Sech'on 25-8-503(8) ofthe revised (June 1985) Colorado Water uali ConLrolAct <br />requires the Division to " etermine whether or nor arty or al ojthe water quality standar ased a uent limitations are <br />reasonably related to the economic, environmental, public heal[ and energy impacts to the publican afjectedpersons, and <br />are in furtherance afthe policies set forth in sections 25-8-192 and 25-8-104. <br />The Colorado Discharge Permit System Regulations, 61.0, futther define this re uirement under 61.11 and state.' "Where <br />economic, environmental, public health and energy impacts to thepublic and af~ected persons have been considered in the <br />classificaA'ons and standards setting process, permits written to meet the standards may be presumed to have taken into <br />consideration economic factors unless: <br />a) Anew permit is issued where the discharge was notpresent at the time of the classification and standards rulemaking, or <br />b) In the case oja continuing dischar e, additional information or ((actors have emerged that were not anticipated or <br />considered at the time of the classif~ation and standards rulemaCa'ng. " <br />Furthermore, this is not a new discharger and no new information has been resented regarding the classifications and <br />standards. Therefore, the water qua/try standard-based effluent limitations ofPhis permit are determined to e reasonably <br />related to the economic, environmental, public health and energy impacts to the public and affected ersons and are in <br />furtherance of the policies set forth in Sections 25-8-102 and 104. Ifthe permittee drsagrees weth [his~nding, pursuant to <br />61.11 (b) the permittee should submit all pertinent information to the Division during the public notice period <br />B. C Reporting <br />1. Dischar a Monitorin Re ort' Colowyo is required to submit a Dischar eMonitoring Report (DMR) on a ouarterly basis to <br />the Division. T is report should contain the required summarization o~he test results for parameters shown in Table VI-1 <br />and Parts I B.1. and I B.2. of the permit. The original lab sheets shou d also be attached, so that the Division can verify if <br />calculations were made properly.
