<br />DEVEIAPMENT STANDARDS, USR-978 <br />83rd Joint Venture Resource <br />Page 2 <br />13. The operator of the facility shall comply with the approved road <br />maintenance agreement. <br />14. All liquid and solid wastes shall be stored and removed for final <br />disposal in a manner that protects against surface and groundwater <br />contamination. No permanent disposal of wastes shall be permitted <br />at this site. <br />15. The special review permit site shall be maintained in compliance <br />with the required emissions permit obtained from the Air Pollution <br />Control Division, Colorado Department of Health, for fugitive dust <br />and emissions. <br />16. Overburden and topsoil materials shall be handled and stored in a <br />manner that controls fugitive dust, blowing debris, and other <br />potential nuisance conditions. All stockpiles of overburden along <br />the east border of the property shall be seeded with adaptive <br />grasses within one planting season after they are created. Dust <br />shall be controlled on all haul roads, so that it does not <br />constitute a nuisance to adjacent property owners. Fugitive dust <br />must be controlled on this site and in accordance with the approved <br />dust control plan. <br />17. The special review permit site shall be maintained in compliance <br />with the required NPDES permit obtained from the Water Quality <br />Control Division of the Colorado Department of Health. <br />18. The maximum permissible noise level shall not exceed the industrial <br />limit of 80 dB(A), as measured according to 25-12-102, Colorado <br />Revised Statutes. <br />19. The property shall be maintained in compliance with Sections 53 and <br />26 of the Weld County Zoning Ordinance. <br />20. All construction on the property shall be in accordance with the <br />requirements of the Weld County Building Code Ordinance. <br />21. The property owner or operator shall be responsible for complying <br />with the Design Standards of Section 24.5 of the Weld County Zoning <br />Ordinance. <br />22. The property owner or operator shall be responsible for complying <br />with the Operation Standards of Section 24.6 of the Weld County <br />Zoning Ordinance. <br />
