Response to Technical Adeq~y Review, 19 March, 2001 • Page 2 <br />Item no. 1 Issue: New Access Road <br />CommenUdeficienc The road im rovements are inte rel to the minin activities <br />Res onse <br />The existing access road for Line Camp is considered inadequate and unsafe by the Colorado Department of <br />Transportation, and that agency requested that the requested separate entrance to the pit (originally planned for the <br />south end and planned to be entirely in the permit area) 6e relocated and combined with a relocated access to Line <br />Camp itself. Although the new entrance will not be used for regular access to Line Camp while mining is underway, it <br />will be used as the new permanent entrance, and provision of the entry to replace existing access both to Line Camp <br />and to the field used for the pit is a requirement of both the CDOT and the landowner. Since these improvements are <br />needed whether the mining is done or not, the mining is incidental to the improvements and a fortuitous event for the <br />landowner. As discussed, we have included this land in the permit boundary, and modified the maps and other <br />exhibits as appropriate to include these as permanent post-mining features. This increases the total permit area and <br />affected area by approximately 1.2 acres. (In addition, based on other comments and suggestions, about 2.4 acres <br />was added elsewhere. An amendment is therefore re wired and rovided. <br />Item no. 2 Issue: Gravit drain i e <br />CommenUdeficienc Please clarif the status <br />Res onse <br />As with the access road, the Applicant was providing information as to items which are to be existing at the time <br />mining operations are to commence. The landowner is requiring that the applicant, prior to being allowed to begin <br />any mining of his land, provide necessary improvements to his land to allow for continued operation of his irrigation <br />system and to correct problems with returning carrier water to the Dolores River. Old ditches for return flows have <br />been silted in and are not useable, and have created a problem with shallow flooding and excessive evaporation loss <br />in recent years. The ditches were also not located at the lower end of the property and did not allow proper irrigation. <br />This pipe, to be installed by Four States Aggregates before being allowed to do any mining, fixes these problems. <br />Since it was not viewed as part of the mining operation for regulatory purposes, it is listed as a permanent structure <br />within 200 feet of the affected lands, and therefore subject to compensation agreements. The pipe was originally <br />scheduled for installation in the Fall of 2000, but was delayed due to weather and ground conditions. As discussed, <br />an additional area of a roximatel 0.5 acres has been added to the ermit area to include land for this i e. <br />Item no. 3 Issue: Road for landowner use after reclamation <br />CommenUdeficienc The 1740' road is artiall outside the ermit boundaries. <br />Res onse <br />The location of the road has been chan ed to came corn letel within the ertnit boundaries. <br />Item no. 4 Issue: Construction of feeder ditches <br />CommenUdeficienc The ro osed ditches are not included in the ermit area. <br />Res onse <br />Rather than construct new ditches to feed the ponds, at least two of the existing feeder ditches will be restored from <br />the permit boundary to the pond shore; the third (northernmost) ditch may either be restored or a new alignment <br />used, based on coordination with the landowner. This had been taken into account in listing affected areas. Based <br />on other recommendations, approximately 1.9 acres was added to the permit area by moving the western boundary <br />to the right of way for Highway 145, thus including all portions of the feeder ditches and the Home Ditch itself inside <br />the ermit area. <br />Item no. 5 Issue: Owner's names on Exhibit C ma <br />Comment/deficiency Please submit an Exhibit C map which shows...and owner's name, type <br />of structures, and location... <br />Res onse <br />Exhibit C, Ma C-1, has been revised to show there nested information. <br />
