3) Washington Lease: An agreement made February 28, 1959, betcaeen
United States Smelting, Refining and Milling Company and Marcy-Shenandoah
Corporation and subsequent revisions made by agreement between Washington
Mining Company and Standard Metals Corporation; successors to United Smelting,
Refining and Milling Company and Marcy-Shenandoah respectively. The original
agreement stated provisions for leasing the described patented and unpatented
mineral claims ("Sunnyside Properties") in the Eureka Mining District, San
Juan County, Colorado, for purposes of extending the Gold King Lower Tunnel
into said premises and to conduct exploration, development and mining operations
therein through said tunnel.
4) 21ogu1 Lease: A lease, originally dated August 17, 1949, be'=ween
[he Mogul Milling Company and Sunbank Corporation, whereas, Standard Metals
Corporation, succeeding under this lease, has obtained all rights to use the
workings (listed as eighteen patented mining claims in San Juan Counl:y)
therein, for all uses and purposes incident to its mining operation :in the
leased premises and in other properties, and for any and all other uses and
purposes, including the right to remove from the leased premises, ship,
treat, sell and dispose of a21 ores, materials and minerals taken thE~refrom
under the agreements in said lease.
5) Mill and Tailings Properties: All affected lands described in the
main body of this application and in Exhibit A lie within the boundaries of
patented and unpatented millsite, placer, and lode claim properties cwned
solely by the applicant, Standard Pietals Corporation.
