Box 245 <br />Silverton, Colorado 81433 <br />Dear Mr. Ott: <br />303-381-5671 <br />Tt is ironic that your firm should be required to solicit <br />a statement from San Juan County regarding your limited impact <br />mining operation permits with the State of Colorado. <br />San Juan County attempted a land use approach over a year ago <br />which would have integrated the entire procedure, as you .are aware. <br />But before that year was over, the State of Colorado itself--through <br />its public defender, district attorney and attorney gener;~l--con- <br />veniently determined that counties have no jurisdiction o•rer mining <br />operations, and cannot permit or fail to permit any activity related <br />to a mining operation short of structural work covered by the <br />building codes. <br />In this connection, assuming your request relates to basic, <br />overall and existing operations, San Juan County does not have <br />any comment to make for your pennit file because San Juan County <br />apparently does not have any standing or jurisdiction to make <br />such comment. Specifically, your operation is not in conj.'lict <br />with existing zoning regulations since the Congress of thE~ United <br />States has determined the land use of mining claims regardless of <br />what local desires or needs may or may not be in a given ease. <br />This letter, then, may be deemed county clearance foz• your <br />operations, including the American Tunnel at Gladstone, t}ie Standard <br />Mill (former Shenandoah Mill) above Silverton, and all related <br />a mining and milling operations. <br />Your assistance in working with us--despite its frustrations-- <br />has been greatly appreciated. <br />cc: County Commissioners <br />Sincerely, <br />~~~~/ <br />Allen Noss an <br />Lard Use Administrator <br />San Juan County <br />-46- <br /> <br />
