E7+HIBIT M - Rule 2, Section 2.I2
BOARD OF COUNTY COMMISSIONERS
San Juan County .
P.O. Bci 455 Silverton, Colorado 81433
September 19, 1977
Jerry Ott
Resident Manager
Standard Metals Corporation
P. O. Box 245
Silverton, Colorado 81433
Dear Mr. Ott:
303-381-5671
Tt is ironic that your firm should be required to solicit
a statement from San Juan County regarding your limited impact
mining operation permits with the State of Colorado.
San Juan County attempted a land use approach over a year ago
which would have integrated the entire procedure, as you .are aware.
But before that year was over, the State of Colorado itself--through
its public defender, district attorney and attorney gener;~l--con-
veniently determined that counties have no jurisdiction o•rer mining
operations, and cannot permit or fail to permit any activity related
to a mining operation short of structural work covered by the
building codes.
In this connection, assuming your request relates to basic,
overall and existing operations, San Juan County does not have
any comment to make for your pennit file because San Juan County
apparently does not have any standing or jurisdiction to make
such comment. Specifically, your operation is not in conj.'lict
with existing zoning regulations since the Congress of thE~ United
States has determined the land use of mining claims regardless of
what local desires or needs may or may not be in a given ease.
This letter, then, may be deemed county clearance foz• your
operations, including the American Tunnel at Gladstone, t}ie Standard
Mill (former Shenandoah Mill) above Silverton, and all related
a mining and milling operations.
Your assistance in working with us--despite its frustrations--
has been greatly appreciated.
cc: County Commissioners
Sincerely,
~~~~/
Allen Noss an
Lard Use Administrator
San Juan County
-46-
