must be notified 48 hours in advance that heavy equipment will.be moved onto <br />National Forest System lands and that surface disturbing activities will commence. <br />2. The Forest Service must be notified of any proposed alterations to the exploration <br />plan and access on the Coal Exploration License (CEL). Any changes to the existing <br />plan are subject to Forest Service review, and may result in additional conditions of <br />use. <br />3. All locations of drill pads and new temporary road alignments must be approved in <br />the field by the Paonia District Ranger or his/her representative before any ground <br />disturbance or construction begins. <br />4. The Licensee will be required to obtain a Road Use Permit (RUP) from the Forest <br />Service prior to using existing National Forest System Roads to access the CEL or on <br />the CEL. A performance bond will be required as part of the RUP. Roadwork will <br />be performed only upon authorization of the Paonia District Ranger, and will follow <br />construction specifications identified by the Forest Service. Roads will be designed <br />and constructed to provide maximum stability and protect the surface resource. All <br />roads will be maintained or constructed to USFS specified standards for either <br />temporary or classified roads, as appropriate and approved by the USFS, with a <br />design speed of 15 mph. With respect to use of NFSR 711, there maybe specific <br />work required for stabilizing. the road to handle larger vehicle traffic to prevent <br />additional sedimentation into the Dry Fork of Minnesota Creek. This work will be <br />performed as directed by the Paonia District Ranger. <br />5. Temporary roads and drill pads will be designed to minimize erosion and <br />sedimentation. Drill pads will be sized to minimize surface disturbance, and will use <br />vegetation clearing rather than full soil disturbing construction techniques wherever <br />possible to minimize the amount of soil disturbance. Drill pads will be designed to <br />prevent or diminish overland flow from entering the site during precipitation events. <br />Pad sites will be sloped to drain all spills on site precipitation into the mudpits. If <br />necessary, pits will be pumped out to reduce their content and insure that overflow <br />does not occur. Fluids will be contained and disposed at a State approved site. <br />The licensee will be responsible for soil preservation/protection and final reclamation. <br />The Licensee will be responsible for soil losses due to erosion and gullying. Topsoil <br />stockpiles will be located Yo minimize soil contamination or loss. Soil from mudpits <br />will be stockpiled for use during reclamation. Rock material will be stockpiled <br />separately. <br />7. Staging areas must be approved in advance by the Paonia District Ranger. <br />8. All surface disturbing activities including reclamation must be supervised by a <br />responsible representative of the Licensee who is aware of the terms and conditions <br />of the projects permits/licenses.
