Resolution No. -a~ 31 • ' ' Page 2 1. Extraction of gravel shall be limited to the mining of shallow gravel deposits and gravel bars, and shall not extend below the waterline. 2. The gravel extraction and processing operations shall canply with the guidelines and requirements set forth in any future Animas River }fanagement Plan which the County may adopt. 3. The Operator shall exercise due care to control the river bank erosion on both sides of the pit area, pursuant to applicable State and Federal statutes and regulations. 4. The gravel extraction and processing operations shall comply with all applicable state and local health department rules and regulations regarding air c~nissions, fugitive dust, and noise. Hours of operation for processing (crushing) to be from 7:00 A.1d. to 6:00 P.}1. !Monday through Saturday. Hours of processing operations may be extended to 5:00 A.1±. to 9:00 D.!1. as emergency hours only. 5. Applicant, and any successor operator, shall participate in a comprehensive Animas River A?anagement Plan Study, and shall fund its fair share of the cost of such a study on an equitable, pro rata basis with other gravel extraction operation located in and alcng the Animas River fran Trimble Lane Bridge to Bakers Bridge. 6. 911 verbal and written representation of the applicant shall be deemed to be conditions of approval except to the extent they are modified by the specific conditions in the resolution. 7. Periodic Review and Enforcement: This land use approval is expressly contingent upon and subject to the operator's receipt of and compliance with all required state permits or approvals, including, but not limited to, the permit for the proposed operation required from the Colorado Mined Land Reclamation Board. Should the Colorado :~]ined Land Reclamation Board or any other State agency, whose permit or approval is required for the operation, suspend or revoke such permit or approval for the operation, the County's land use approval shall be deemed suspended or revoked, as appropriate. Any written allegations that the operation is in violation of the teens and conditions.of approval shall be referred to the County Planning Staff for investigation. The County staff shall promptly investigate any such written allegations concerning violations and report their findings to this Board.
