Sandco Inc. of Durango, has made <br />supplication to Board of County Crnmissioner's for land use approval on <br />property Ddr. Dillon leases fran Dalton land and Cattle Canpany and described <br />ss being located u~ the NE; of Section 15, T36iL, RJW.; and <br />~'7fiEREAS, the project consists of combining two existing 110 Permits <br />into a 112 Permit for an existing gravel extraction operation located between <br />Trimble Bridge and the Hermosa ~4eadrnvs Camper Park, encompassing approximately <br />s. E7 acre area; and <br />{yiTF'RFaS, Section 3.2.4 of the County's Subdivision Regulations, the <br />Ia Plata County Land and Resource Management Program, requires any change in <br />land use, such as proposed by the Applicant, be processed as a Category I <br />project with Planning Crnmission review and recrnrrendation. The Colorado <br />1:fined Land Feclamation Act requires that prior to the Mined Land Reclamation <br />Eoard issuing a permit, and for which the Applicant has made application to <br />the Mined Land Reclamaiton Division for a regular impact, Section 112 <br />c_neration, that the County, as the local government entity with land use <br />jurisdiction over the proposed site, find that the operation would not be in <br />violation of the County's zoning or subdivision regulations; and <br />WfIEEtEP.S, the' La Plata County Planning Crnmission reviewed the <br />proposal at its A'farch, 1987 meeting and forwarded the application to the <br />Board of County Carmissioners for action with a reca~mendation of approval <br />by a 3 - 1 vote; and <br />wHFrtFaS, this Board has conducted a noticed public meeting on <br />this application, at which both the applicant and other members of the public <br />jj were given the opportunity to present evidence. This Board has also received <br />jl and considered written statanents, docimientation, and dgnonstrative evidence <br />fran the applicant and manbers of the public. This Board has also received <br />and considered the staff's analysis of the proposal and Planning Conmission <br />~~ recrnmendations. <br />~i NOW, THEREFORE, $E IT RESOLVED BY THE BOARD OF CCIJiv'I'Y CO~.114ISSIOVER.S <br />~I OF LA PLATA CIJiJNTP, COLORADO AS FOLLONS: <br />The application of Sandco Inc. of Durango for land use approval <br />to e.~cpand two 110 Permits into a 112 Permit for an existing gravel extraction <br />and processing operation located within the Animas River floodway between <br />the Trimble Lane Bridge and the Hermosa Meadows Camper Park, is hereby <br />approved, subject to the following conditions: <br />
