'Visual' observation is observing the discharge to check for the presence of a viable sham or floating oil. <br />13. 'Water Quality Control Divi®oa' or 'Division' means the state Water Quality Control Division as established in 25-8- <br />101 et al. <br />D. REPORTING <br />1. Sianaton Reauirmtents <br />All reports required for submittal shall be signed sad certified for accuracy by the permittee in accord with the following <br />criteria: <br />a) 1n the use of corporations, by a principal executive officer of u least the level of vice-pre®dmt or his or her duly <br />authorized representative, if such reprraentative is responsible for the overall operation of the facility from which the <br />discharge described in the form origimtes; <br />b) La the use of a partnership, by • general partner, <br />c) ha the use of a sole proprietorship, by the proprietor, <br />d) In the use of a municipal, state, or other public facility, by either a principal executive officer, rwldng elected <br />official, or other duly authorized employx. <br />E. SPECIAI, REQIIIItEMENTS <br />L Materials Containment Plan <br />• Pursuant to Sections 6.9.3 (5) and (ti)(b) of the Regulation for the State Discharge Permit System, the permittee is <br />required W submit a Mnf.r;nte Coatainmmt Plan. Such a plan was previously submittal to the Division. An update of <br />the plm shall ba submitted to the Permits sad Eaforcemmt Section, Water Quality Control Division within ninety (90) <br />days after the effective date of this permit sad must be implemented. The update of the pLn shall include changes in the <br />information sad procedurm far the prevention and containment of spills of materials used, processed or stored u the <br />facility which if spilled would have a rrasonabla probability of having a viable or otherwise detrimental impact on <br />waters of the State ~/ 2/. The updated phm shall include, but not necessarily be limited to: <br />a) An updated history of the spills which Gave occurred in the three (3) years preceding the effective date of this <br />permit. The history shall include a discussion oa the cause of the spills and a the preventative rtreasurea designed to <br />nl;mitif.. them from reoccurring; <br />b) Aa update of the reporting system which will be used to notify, u a ,n;nimnm, responsible facility maaagemeat, the <br />Water Quality Control Division, the Fnviroameaml Protection Agmcy, downstream water users within 5 miles <br />downstream of the facility, and local health officials; <br />c) A description of any changes in the preventative facilities (including overall facility plot) which prevent, contain, or <br />tree spills and unplanned discharges; <br />d) A cturent list which includes the volumes or quantities of all materials used, processed, or stored u the facility <br />which reprrsmt a potential spill threat to surface waters. The location of stored material shall be indicated oa the <br />fuility plot submitted for item c; <br />e) Aa implementation schedule for additional facilities which might be required in item c, but which aro not yU <br />operational; <br />C I <br />
