gradient is altered, or if the road is otherwise upgraded". <br />As such, the Grand Valley Book Cliffs Notice of Intent must be revised to include a discussion <br />as to how Ark Land Company will comply with the applicable requirements of Regulations <br />4.03.3(1) through 4.03.3(7) pertaining to Light-Use Roads. Please include designs for these <br />roads that reflect compliance with the applicable design criteria of Regulations 4.03.3(1) <br />through 4.03.3(5). <br />As an additional example, portions of the Notice of Intent that pertain to proposed topsoil <br />stripping, salvaging, and redistribution need to be revised to reflect the requirements of <br />Regulation 4.21.4(5) regazding segregation, storage, and redistribution of A, B, and subsoil <br />horizons. <br />Further, portions of the Notice of Intent that pertain to reclamation of coal exploration activities <br />should be revised to reflect the revegetation standards of Regulations 4.21.4(6), (6)(a), and <br />(6)(b) applicable to operations proposing to remove 250 tons or less of coal. <br />6. Regarding the Performance Standards at Regulation 4.21,4(7) pertaining to diversions of <br />overland flow, please revise the first paragraph on Page 10 of the "Exploration Plan" to include <br />the following sentences: "In accordance with Rule 4.21.4(7) of the Regulations of the Colorado <br />Mined Land Reclamation Boazd for Coal Mining, and with the exception of small and <br />temporary diversions of overland flow of water azound new roads, dri[I pads, and support <br />facilities (such as camps and lay down areas), no ephemeral, intermittent or perennial stream <br />shall be diverted during coal exploration activities. Overland flow of water shall be diverted in <br />a manner that (a) controls erosion; (b) to the extent possible using the best technology currently <br />available, prevents additional contributions of suspended solids to stream flow or runoff outside <br />the exploration azea; and (c) complies with Rule 4.05.3 and all applicable State or Federal <br />requirements." <br />Regazding the Performance Standazds at Regulation 4.21.4(10), please revise the first <br />paragraph on Page 10 of the "Exploration Plan" to include the following sentence: "In <br />accordance with Rule 4.21.4(1) of the Regulations of the Colorado Mined Land Reclamation <br />Boazd for Coal Mining, coal exploration activities will include the use of sediment control <br />measures such as those listed in Rule 4.05.5." <br />Regarding the Performance Standards at Regulation 4.21.4(11), the definition of "acid-forming <br />materials" can be found at Regulation 1.04(2), and the definition of "toxic-forming materials" <br />can be found at Regulation 1.04(139). Please revise the first pazagraph on Page I 1 of the <br />"Exploration Plan" to include the following sentence: "Any toxic- or acid-forming materials <br />that may be encountered during coal exploration and reclamation activities will be handled and <br />disposed of in accordance with Regulations 4.05.8 and 4.14.3 of the Regulations of the <br />Colorado Mined Land Reclamation Boazd for Coal Mining." <br />9. The Division is conducting its review of the reclamation cost estimate for the activities <br />proposed under this Notice of Intent. We will contact you if we have any questions in this <br />regazd. <br />
