Adequacy Review <br />Regulation 2.02.2(2)(b) requires Notices of Intent to include the "name, address, and telephone <br />number of the representative who will be present at (emphasis added) and responsible for <br />conducting the exploration activities". If this representative will be someone other than the <br />persons identified as the "Pennittee" and the "Inspection Contact", please provide this <br />additional information. <br />2. Regarding the narrative description and map of the exploration area required by Regulation <br />2.02.2(2)(c), the table in Part II, line 1. b. (Page 2) of the Notice of Intent indicates that <br />Sections 10, 15, and 16 will lie within the exploration area. However, Figure 1, entitled <br />"Location Map, Federal Coal Exploration License Application Modification", does not show <br />these three sections as being within the azea identified as "Modified Exploration License Area". <br />If these three sections aze not to be included within the exploration azea, please provide a <br />revised NOI application Page 2 with these three sections removed. <br />3. Regarding the information required by Regulation 2.02.2(2}(e) pertaining to right of entry, it is <br />stated on Page 8 of the "Exploration Plan" that "The Bureau of Land Management will provide <br />right of access with the approved Federal Coal Exploration License". Please revise this <br />pazagraph to provide information regazding the status of Ark Land Company's application to <br />the BLM for this aforementioned Exploration License. Please indicate whether the application <br />for this Exploration License has been submitted, is in review, or has been approved. If said <br />Exploration License application has been approved, please provide the date of approval. If the <br />Exploration License has been given a specific designation (number, etc), please provide this <br />information as well. <br />4. Regarding the information required by Regulation 2.02.2(2)(8) requiring a description of the <br />methods to be used to conduct coal exploration and reclamation, it is stated on Page 9 of the <br />"Exploration Plan" that, "Camp sites and/or staging areas to be used by the drilling contractor <br />will be reviewed with and approved by the BLM representative prior to use". Please revise this <br />sentence to indicate that proposals for such sites/areas, as well as plans for the reclamation of <br />such sites/areas, will also be reviewed and approved by the Division prior to their use. If Ark <br />Land would like to address the locations, sizes, surface access approvals, and reclamation plans <br />for these support facilities, it may revise this Notice of Intent now to do so. <br />5. As noted above, the Division has determined that the activities described in this Notice of <br />Intent will "substantially disturb" the natural lands surface of the exploration azea. As such, <br />compliance with Regulation 4.21 is required. Please revise the Notice of Intent to include <br />discussions relative to the requirements of Regulation 4.21. <br />For example, Ark Land Company is requesting approval of up to 2.35 miles of new roads, of up <br />to 10.55 of "reestablished" roads, and of up to 11.36 miles of "reconditioned" roads (Table 1, <br />"Road Use Summary", page 8 of the "Exploration Plan"). Regulation 4.21.4(3)(b) states, "Any <br />new road used for coal exploration, or any existing road which is significantly altered for use in <br />coal exploration, shall comp) y with the provisions of (Regulations) 4.03.3 ("Light-Use Roads") <br />and 4.04 ("Support Facilities").
