III IIIIIIIIIIIIIIII ;_ ~ ~ <br />RESOLOTION OF THE <br />PITRIN CODNTY BOARD OF CODNTY COMl7ISSIONERS <br />GRANTING THE COLORADO STATE DEPARTMENT OF HIGIIWAYS <br />A SPECIAL REVIEW PERIKIT TO OPERATE THE INDEPENDENCE GRAVEL PIT <br />Resolution No. 84- 44 <br />WHEREAS, the Colorado State Department of Highways (hereinafter <br />"Applicant") has requested Special Review approval to operate the <br />Independence Gravel Pit which is located approximately 12.5 miles <br />east of Aspen adjacent to State Highway 82; and <br />WHEREAS, a public hearing was held before the Board of County. <br />Commissioners (hereinafter "Board") wherein evidence and testimony <br />were presented with respect to the proposed gravel pit. <br />NOW, THEREFORE, BE IT RESOLVED by the Board that it does hereby <br />grant approval for the Special Review permit subject to the following <br />conditions: <br />1. This permit shall run for a seven (7) year period commencing <br />on the date of approval by the Board of County Commissioners. <br />2. Prior to April 1st and the commencement of operations each <br />year of the permit period, the applicant shall submit a <br />statement of continued compliance with the conditions of <br />this permit to the County Planning Office. The Planning <br />Office shall schedule a public hearing before the Board <br />of County Commissioners at which time the applicant's perfor- <br />mance under the terms of this permit shall be reviewed <br />along with the applicant's operating and reclamation plan <br />for the next season's operation. <br />3. The hours of operation of the Pit shall be limited to between <br />7:00 A.M. and 7:00 P.M. <br />4. This permit shall be non-transferable. <br />5. At all times when the Pit is in use, appropriate routine <br />safety procedures in conformance with all applicable state <br />and federal laws shall be adhered to. <br />6. The production site(s) shall comply with the State of Colorado <br />Noise Abatement Law Title 25, Article 12. <br />7. No wastewater shall be permitted to enter natural drainages. <br />All on-site drainage shall be retained in the non-discharging <br />holding ponds, or other acceptable methods approved by <br />County Environmental Health Office. <br />8. The applicant shall comply with all applicable State and <br />County air pollution laws. <br />9. Open burning of shrubs, trees, branches, etc., shall be <br />allowed only upon issuance of such permits by the County <br />Environmental Health Office. <br />10. Waste asphalt generated at the beginning and ending of <br />each production run shall be disposed of in a sanitary <br />land fill approved by the County Environmental Health Office. <br />11. Portable toilets serviced and maintained in a sanitary <br />condition will be available during active operation. <br />
