Exhibit M -Other Permits The applicant has indicated that appropriate permits will <br />be applied for through the CDPHE-APCD, CDPHE-WOCD and DWR. Additionally, DMG has <br />received comment from COE, dated 1 /27/99, indicating that jurisdictional waters and <br />wetlands are located within lands proposed to be affected. Please clarify whether the <br />applicant will be seeking a permit through COE. If the applicant will not be seeking a COE <br />permit, please demonstrate how operations will be conducted to ensure compliance with <br />applicable federal dredge and fill requirements, as required by Rule 3.1.611)(c>. <br />10. Exhibit O -Owner(s) of Record Exhibit O was incorrectly labeled "Exhibit M". <br />However, the required information appears to be present. No response necessary. <br />11. Exhibit S -Permanent man-made Structures (a) Exhibit S contains a certified <br />engineering evaluation which commits to a mining setback of 30' from permanent man- <br />made structures. The evaluation certifies a structures safety with a minimum setback of <br />21.5', but provides an additional 8.5' for a total setback of 30'. <br />DMG has reviewed the evaluation and finds that the commitment to maintain a 30' <br />mining setback from structures demonstrates compliance with the Act and Rules. <br />Copy of DMG review and page 24-1 from the Caterpillar Performance Handbook, <br />edition 26, attached. <br />Ib- Exhibit C delineates a proposed haul road, approximately 2,750' long and 25' wide. <br />Portions of the proposed haul road are located within the 25' easement for a utility line. <br />The application does not indicate the owner of the utility line. Please revise Exhibit C to <br />show the location of the proposed road not closer than 30' to the utility line, OR please <br />provide a notarized damage compensation agreement, required by Rule 6.4.19(a), for the <br />utility line.
