<br />1) Flow data on the creeks running across site, the ditch <br />paralleling the site and State Highway 9, McKay Ditch, <br />and the dikes and standpipes to be constructed <br />(specifications requested in Parts B (1) and B(2) of this <br />letter) must be submitted. The following data is <br />required: <br />a) What is the maximum flow of each waterway? <br />b) Who owns McKay Ditch, and the ditch paralleling <br />State Highway 9? <br />c) What is the size of the 100-year 24-hour Storm <br />event? <br />2) Storm runoff is to be impounded in a "water quality <br />pond" on the site. No maximum volume is given, and the <br />diversion ditches and/or berms are neither shown on the <br />map, nor are they described in terms of the Design Storm <br />Event. A "perforated stand pipe outlet surrounded by a <br />gravel pack" is described as an outlet from this pond, <br />but to where, or of what size, is not included. Please <br />include specifications and details of these storm runoff <br />handling measures. <br />3) The projected water requirements (p. G-2) are not <br />included in this application. It is stated that they will <br />be submitted once operational planning is complete. They <br />must be submitted to DMG before we can complete a review <br />of this permit application. Please do so. <br />4) Please demonstrate that the Operator is in compliance <br />with the Office of the State Engineer's water <br />augmentation requirements, and that a water augmentation <br />plan is in place. If the Operator is not currently in <br />compliance, the financial warranty will be increased to <br />include the cost of backfilling the ponds on the site. <br />D) Exhibit H: Wildlife Information <br />While many species were described as being present at the <br />site (either using it to feed or migrating through the <br />area) whether any of them are Threatened or Endangered <br />Species was not included in the application. The T&E <br />status of these species must be explicitly described (as <br />required under Rule 6.4.8 of the Construction Materials <br />Rules and Regulations). If any of these animals are <br />Threatened or Endangered, a DOW analysis is required to <br />evaluate the impacts upon the populations using the site. <br />Also, a list of any fish present in the three creeks on <br />the site should be included. <br />E) Exhibit S: Permanent Man-Made Structures <br />Both Public Service Co. and the Colorado Department of <br />Transportation own and maintain permanent structures on <br />or near the site. The application states that they will <br />be contacted regarding relocations and access agreements <br />impacting the mining site. Until such agreements are in <br />
