4. On Page D-2 of your application you state " In addition, a portion of the Phase 3 topsoil <br />and overburden will be removed to adjust the flood boundary....." Please explain this <br />statement and show, on an Exhibit C Map, the proposed flood boundary adjustment. <br />5. Your Mining Plan, on page D-2, states that the West Fill Area will require installing <br />temporary crossings at the Brighton and Brantner Ditches. Please provide construction <br />plans for the crossings. If Aggregate Industries has not already done so, provide copies <br />of the agreements for encroachment into the ditch companies properties or rights-of--way <br />for construction of the crossings. <br />6. Recently the Mined Land Reclamation Board included on page 6 of the 112c permit <br />application package a "Permit Condition" regazding reportable spills, Your application <br />does not have the permit condition. Please add the following condition of approval to <br />your application. <br />A reportable spill is a spill of any toxic or hazardous substance (including spills of petroleum <br />products) within the mined land permit azea reportable to any Division of the Colorado <br />Department of Public Health and the Environment, the National Response Center, the Colorado <br />Emergency Planning Commission, any local Emergency Planning Commission, local Emergency <br />Planning Committee, or the State Oil Inspector. The mine Operator shall notify the Division of <br />Minerals and Geology (DMG) of a reportable sill within the mined land permit area using the <br />same timeframe required by the permit, license, notice, statute, rule or regulation governing the <br />reporting of the spill to the other appropriate agency. Notice of a reportable spill shall be FAXed <br />to: Minerals Program Supervisor, Division of Minerals and Geology, FAX (303) 832-8106. The <br />FAX shall include acall-back number of a responsible company official for DMG staff to use as <br />a contact. <br />7. Please provide your plans for containment of 110% of the greatest potential spill of bulk <br />petroleum products or other toxic liquids to be stored in the permit azea. <br />8. Your mining plan for Phase 1 says "scrapers will strip the topsoil and overburden and <br />either stockpile it along the perimeter of the area to be mined, on top of the resource or <br />transport it to the fill area...." This phase will either be reclaimed as upland or wet <br />meadow. These two final land uses require topsoil replacement. Please state which of <br />the three topsoil storage azeas will be used and show the location on the mining plan map. <br />The Division needs to know where the topsoil will be placed for plan review purposes <br />and calculation of the financial wan•anty. If the planned location changes at a later date, <br />A. I. can submit a Technical Revision to show the change. <br />9. Your plan states that Phase 2A is being mined under Permit No. M-1991-140 and that <br />reclamation for this azea will be incorporated under this permit upon approval of the <br />DMG. Will any extraction activities in Phase 2A be conducted under this proposed <br />permit? If so provide your plans to complete the resource extraction. If the permit is <br />approved, as written, only reclamation activities will be allowed to occur in Phase 2A. <br />
