`~ <br />i <br />Mr. Steve Shuey <br />Division of Minerals & Geology <br />Durango Field Office <br />March 24, 1995 <br />Page 2 <br />A copy of the Summary and Recommendations from the cultural resource survey report submitted to <br />the State Historic Preservation Office is included. The recommendation is that there will be "no <br />adverse effect" to the listed site from the mining operation. There has not yet been a decision made <br />by SHPO as to the disposition of the site within the boundaries of the permit, that is eligible to be <br />included in the National Historic Register. This decision should be rendered within the next thirty <br />days. The operator will commit to not disturbing the designated site with mining activities until an <br />agreement is reached between the property owner and SHPO. <br />PRE-MINING AND MINING PLAN MAPS <br />The wetlands and small pond location has been added to the Exhibit C-1 Map. <br />The hydropower conduit is located within the limit of mining disturbance, approximately three feet <br />below the surface and will be used as the general location for the access route. There currently is a <br />vehicular access route on top of the hydropower conduit, as this was also the location of the <br />abandoned railroad grade. The area of the hydropower conduit may be mined in the future if <br />agreements are reached with the owner of the line to allow this. The Division will be supplied with a <br />copy of that agreement prior to any excavation of the area containing the hydropower conduit. <br />MINING PLAN <br />Prior to surface disturbance activities, this operation is required to obtain a Stormwater Discharge <br />Permit from the Colorado Department of Public Health and Environment. This permit requires the <br />development of a Stormwater Management Plan which incorporates structural and non-structural <br />Best Management Practices (BMPs) to protect the quality of any Stormwater discharge from this <br />site. The structural components of this plan during mining activities may include, but not be limited <br />to silt fencing, straw bale barriers, erosion prevention/control ditches, and site grading. The non- <br />structural controls used will include revegetation and mulching of areas recently seeded prior to plant <br />establishment. A copy of this approved permit will be forwarded to the Division when it is received. <br />As stated in Exhibit G, wash waters could be used to produce concrete aggregate. The quantity of <br />wash waters needed will be determined by the amount of concrete aggregate decided to produce. If <br />this related activity occurs on-site, wash waters will be recycled through a series of two or three <br />small sediment ponds, sized to accommodate the quantity of water required. All the wash waters <br />used will either be recycled or retained in the washed material and transported off-site with that <br />material. There will be no discharges of the product wash waters allowed, therefore, no NPDES <br />permit is required. <br />
