OSM Inspection <br />Page 2 <br />• West mine yard, immediately west of the no. 2 portal. This drainage <br />carries run-off from major storms, but is not a perennial stream. It <br />was to have been diverted Dy two diversion ditches constructed for this <br />-purpose. Unfortunately, the diversion ditches were put in and the slope <br />graded so that the last 100' of each diversion ditch emptied, into the <br />major drainage, rather than deflecting the major drainage out through <br />the diversion ditches. The other problem is that immediately west of <br />this drainage, we have a landslide situation, wherein a large portion <br />of the mountainside is failing in a characteristic slump. This land- <br />slide is moving from the diversion ditch down to the elevation of the <br />West mine bench. WSC and the state of Colorado had been discussing the <br />possibility of modifying this diversion situation by making a catch <br />basin and carrying the water across the mine property in a culvert and <br />• ditch to deposit it in the North Fork of the Gunnison River. WSC felt <br />that Mr. Ron Gregg, OSM inspector, was correct in issuing both violations, <br />but WSC feels that there are mitigating circumstances which should enter <br />into each violation. They include. <br />1) Trash resulting from railroad construction which was <br />the responsibility of Railroad Builders to pick up. <br />2) A landslide destroying the effectiveness of the diversion <br />ditch system. <br />3) The fact that the contractors who installed the diversion <br />ditches misunderstood the drawing and installed them with <br />at least lOD' of each ditch sloping in the wrong direction. <br />4) WSC and the state of Colorado realized the potential pro- <br />• blem with this drainage and were attempting to reach an <br />agreement on an effective system which would cure the <br />problem. <br />
