C. 20240 <br />Dear Sir: <br />This letter is in regard to Notice of Violation 79-V-3-23, issued <br />to 4Jestern Slope Carbon, Inc., permit No. 78-155, MSHA I.D. No. 05-00243. <br />We wish to submit inforr,.ation regarding three io a~ written <br />June 7, 1979, by Larry Damarau. <br />First, the time alloo:ed for abatement of each violation eras 30 <br />days or until July 7, 1979. As of this date, June 12, 1979, all three <br />violations have been Laken care of. Abate,:~ent of these violations illus- <br />. trate considerable expense and good faith on the part of the coal mine <br />operators. <br />Addressing the specific violations: <br />Violation Al - Failure to pass surface drainage from <br />disturbed areas through sedimentation ponds, was allowed <br />for in our Colorado ~1ine Land Reclamation Permit, due to <br />the small size of the area and the treatment with gravel. <br />This violation has since been taken care of by directing <br />the sediment run-off through a culvert and into our <br />existing East itine sediment pond. <br />Violation k2 - Failure to use required discharge structures <br />Energy dissipators have been installed in the form of hand <br />placed rock at the out-fall of all discharged points. <br />Violation ~3 - Failure to maintain access and haul roads <br />as required. Plugged culverts were discovered and the <br />blockages were removed from all of the culverts on the <br />property. <br />It is felt that tJestern Slope Carbon has exhibited good faith <br />and a timely abatement of these violations and we hope that this will <br />w sv~c~o~wwr or nowT,.wccr cr.cwcr co~,rwr,r <br />
