d. As noted in the Empire Energy Mid-term Review, item 1-F, the State <br />Engineer's Office commented that the water well permits for Mines 5 <br />& 9 had expired. Have these been renewed? <br />RESPONSE: Permit application form (WRJ-5-Rev. 76) - A permit to <br />Use Ground Water, has been submitted to the Colorado Division of <br />Water Resources for the No. 5 Mine Discharge Well. A copy of the <br />application form has been included in Exhibit 2. No discharge is <br />occurring from the No. 9 Mine. The well permit was allowed to <br />expire. <br />2. Reclamation Plans and Revegetation Success Criteria <br />a. The aoolicant must address reclamation olans and standards for the <br />areas disturbed by Trapper Mining on the Utah Tract and also <br />Empire's 5A portal conveyor system. Also, the Reclamation Plan Map <br />• (Map 29) must be revised to show the Utah Tract, conveyor corridor, <br />and the location of the mine water treatment ponds. <br />RESPONSE: Pages 2.05.4-4, 2.05.4-10, 2.05.4-16, 2.05.4-23, <br />2.05-4.26, 2.05.4-28, 2.05.4-33, and 2.05.4-38 have been revised to <br />address the above issue. Maps 20, 25, and 29 have been revised to <br />include the above disturbed areas. <br />b. The proposed vegetation cover standards at the No. 5, 5A, and 9 <br />portal areas and the red rock crusher site are given as 30 percent <br />cover. This is based on a 1983 study summarized on page 2.04.10-12 <br />(Table 36) of the application. That study showed a total <br />vegetative cover of 58.12 percent with 32.5 percent of that cover <br />perennial species. The proposed standard will be acceptable if the <br />applicant changes the cover standard to a 30 percent cover of <br />perennial species. <br />RESPONSE: Page 2.05.4-28 has been revised to address this issue. <br />39-2 <br />
