RESPONSES TO PAR QUESTIONS FROM COLORADO <br />• MINED LAND RECLAMATION DIVISION <br />1. Legal, Financial and Compliance Information <br />a. Sections 2.03.4(2) & (4) of the Regulations require that the <br />application shall contain a statement of any Current or previous / <br />surface coal mining permits in the united States held by the ./ <br />~7 <br />applicant (including the principal shareholder, in this case Cyprus <br />Coal Company) subsequent to 1970. .., and of any pending permit <br />application to conduct surface coal mining and reclamation <br />operations. A statement of such permit has not been supplied. <br />RESPONSE: Pages 2.03-16R through 2.03-16Re have been included to <br />address this issue. <br />b. The certificate of insurance provided in Exhibit 1 of the <br />application shows a policy expiration date of July 1, 1986. Has <br />this policy been renewed? <br />RESPONSE: The Certificate of Insurance provided in Exhibit 1 has <br />been replaced by a Certificate of insurance effective 7-1-86 <br />through 7-1-87. <br />c. Exhibit 2 of the application contains conies of the NPDES discharge <br />permits for mine water discharges. The copies all show expiration <br />dates during 1979, have these permits been renewed? Also, only the <br />mine water permits were provided, where are the NPDES permits for <br />sediment pond discharges? <br />RESPONSE: The NPDES permit in Exhibit 2 has been replaced by the <br />renewal NPDES permit which expires December, 31, 1990. <br /> <br />39-1 <br />
