Page 2.05.3-21 has been revised to address permanent sealing of <br />drill holes. <br />3. Identification of Land Unsuitable for Surface Mining and <br />Reclamation Pursuant to 43 CFR 3461 <br />In our land use planning process on Federal lands within the permit <br />boundary have been designated unsuitable. However, the following <br />lands within federal lease C-30656 have been identified as bald <br />eagle roost and concentration areas: T.5N., R.91W., 6th P.M. Sec. <br />8: lots 3, 4, 7. These lands were protected previously through <br />Sec. 2 of OSM's permit number CO-0019. We recommend that this <br />protection be carried forward into the permit approval of the <br />subject revision. <br />RESPONSE: No response necessary. <br /> <br />5. Adequacy of Measures to Protect Federal Resources Not Covered by <br />the Rights Granted by the Federal Coal Leases <br />General Comments <br />Section 2.04.12, Prime Farmland Investigation, the discussion needs <br />to be modified based on the following: <br />Amount of rainfall is not a criteria for prime farmland. It is <br />true that the CMLRD made a negative determination for the presence <br />of prime farmland in 1983, however, new data indicates that <br />potential prime farmlands occur within the permit boundary. These <br />potential prime farmlands have not been formally designated. <br />RESPONSE: See response to CMLRD PAR issue 3e above. <br /> <br />39-36 <br />
