RESPONSES TO QUESTIONS FROM U.S. DEPARTMENT OF THE INTERIOR <br />• BUREAU OF LAND MANAGEMENT <br />1. Adequacy of the Proposed Resource Recovery and Protection Plan <br />(R2P2) and Any Conflicts with Future Recovery of Coal Resources <br />Table 55, "Empire Energy - Geologic and Mineable Reserves" was not <br />found in the permit package. An insert sheet titled "Table 56, <br />EMPIRE ENERGY GEOLOGIC AND MINEABLE RESERVES" and "To be submitted <br />by Empire Energy when completed" is included in the confidential <br />volume. The "56" seems to be a misprint since Table 56 is an <br />existino structures list in Volume 1 oaoe 7.05.3-23. Base <br />reserves, mineable reserves, and recoverable reserves, by seam, <br />with supporting geologic data, for all Federal leases associated <br />with the Eagle Mines are required to complete our review of this <br />permit revision. <br />RESPONSE: Table 55, Empire Energy Corporation's Federal Coal <br />• Resource Recovery and Protection Plan (R2P2), Table No. 9, and <br />Table No. 10 have been revised to address these issues. All of <br />these revisions are found in Exhibit No. 35, Confidential Material. <br />2. Compliance with Special Lease Stipulations and Applicable Agency <br />Regulations <br />We have determined that the lessee will not be required under <br />Section 15, Special Stipulation 2(a) and Section 31, Special <br />Stipulation (h)(1) to conduct a paleontological appraisal of the <br />land contained in readjusted Federal leases C-0127865, C-0126480 <br />and C-30656. However, the lessee will still be obligated to comply <br />with Sec. 15, Special stipulations 1(d), 3, and 2(b), (c), (d), (e) <br />and (f) and Sec. 31, Special Stipulations (h)(2), (3), (4), (5) and <br />(6) concerning discovery of oaleontolooical and cultural resources <br />• on readjusted leases C-0126480, C-0127865 and C-30656.
