RESPONSE: Page 2.05.6-18 has been revised to address these issues. <br /> <br />b. Empire has indicated on pages 2.04.3-51 and 2.05.4-17, its <br />intention to in fill the portal area of No. 9 Mine with coarse <br />,eject material and coal waste. No assessment is made of the <br />potential effects this may have on the recharge of and the water <br />quality in downdip aquifers. No indication is made of Empire's <br />intention to modify their monitoring program and include a well <br />within this waste area. There is, in fact, no direct monitoring <br />now or proposed for any current or future waste disposal areas. <br />Empire should assess the impact of this waste disposal. Empire has <br />included the series of ground water monitoring wells in Table 7, <br />page 2.05.4-35, together with the various pump, dewatering, fuel, <br />and dower boreholes which will presumably be plugged and reclaimed <br />early in the post-mining phase. There i5 nowhere in the permit <br />application a commitment made to continue the ground water <br />• monitoring program beyond the period of active mining. Empire <br />should commit to the maintenance of the ground water monitoring <br />system and scheudle into the post-mining period until such time as <br />the Division considers the monitoring unnecessary. <br />RESPONSE: Pages 2.05.4-17 and 2.05.6-18 have been revised to <br />address this issue. Map 11, Hydrologic Monitoring Program Location <br />Map has also been revised to show the location of proposed well 9BF <br />within the reclaimed No. 9 Mine portal area. <br />c. On page 2.04.7-5, Empire indicates that site - specific hydrologic <br />data is being generated for the Trout Creek Sandstone presumably <br />from the three-(3) local wells subsequently mentioned as being <br />completed in the Trout Creek. i.c.. Wells 5, 5A, and Okie Plaza. <br />• The only monitoring data previously included from these wells has <br />consisted of field parameters determined quarterly and full suite <br />39-17 <br />
