<br />.• ~^per cubic yarof sand removed. Paymen ~ royalty shall <br />be made in the month in which such sand or gravel is re- <br />moved from the leased premises, payable at the end of the <br />monthly period. A monthly accounting shall be given to <br />the Lessor of all sand and gravel sold from the leased <br />premises and Lessor may inspect Lessee's books and records. <br />8. The Lessee shall have the right and privilege of <br />using any water from any springs on the leased premises <br />which Lessor may need for the operation of any machinery <br />or for the purposes of carrying on the sand and gravel <br />operation if any such water is needed and available. <br />9. The Lessee, at its option, may extend this Lease <br />for five (5) <br />additional years on the same terms <br />and conditions as are herein contained, except the royalty <br />shall be $.30 ( thirty cents) per cubic yard of <br />gravel removed, by serving written notice upon the Lessor <br />at least thirty (30) days before the expiration of the <br />term and upon the service of said notice, the Lease shall <br />be extended upon all these terms and conditions for the <br />extended term without the necessity of execution of any <br />further documents, provided, however, if either on the <br />date of expiration of the original term of this Lease or <br />the date upon which the Lessee exercises such option of <br />renewal, the Lessee is in fault beyond the grace period <br />herein provided and in performance of any of the terms <br />and conditions of this Lease, the extension of this Lease <br />shall be null and void. <br />10. The Lessor and Lessee shall have the right and <br />privilege of recording this Lease if they so desire the <br />same. <br />11. The Lessee shall only have the right to sub-lease <br />the premises upon written approval of the Lessor, which <br />approval shall not be unreasonably withheld. <br />IN WITNESS HEREOF, the parties have set their hands <br />and seals this 15th day of July , 1980. <br />- 3 - <br />
