MONTOYA , hereinafter referred to as "Lessor", <br />and C & J GRAVEL PRODUCTS, INC., hereinafter referred to as <br />"Lessee". <br />W Z T N E S S E T H <br />In consideration of ten dollars and other good and val- <br />uable considerations, receipt of which is hereby acknowledged, <br />and rent, royalties, and covenants herein specified, the Les- <br />sor hereby leases to the Lessee, his successors and assigns, <br />the following-described real property found in Exhibit "A" <br />attached hereto and made a part hereof, located in the <br />W~ NE4 NW 4, S, Z,)~7• <br />~,/Section 10, Township 39 North (Ute), Range 9 L9est, <br />N.td.P.M., being the Montoya tract. <br />1. This lease is granted for a primary term of ten years <br />commencing on the 9th day of July, 1980, and ending on the <br />9th day of July, 1990, at 12:00 noon or until gravel is ex- <br />hausted on said property, if that occurs sooner. <br />2. The Lessee shall have the right of ingress and egress <br />through the leased premises for the purpose of removing sand <br />and gravel and any materials suitable for use in connection <br />with its business, but shall not interfere with the Lessor's <br />existing access on the said property. If the Lessee uses the <br />present, existing, access road, such use must not interfere <br />with the Lessor and the road must be maintained as it pre- <br />sently exists allowing passenger vehicle traffic. The Lessee <br />shall have the right and privilege of setting up and erecting <br />the necessary buildings, equipment or machinery for the opera- <br />tion of such sand and gravel removal except no building for <br />residence purposes shall be erected on the premises. The Les- <br />see shall be entitled to a reasonable time within which to re- <br />move any and all materials, buildings and equipment, placed <br />on the premises during the term of this Lease or after the <br /> <br />
