identify and characterize the aquifer to be mined in or through. The Division also requests that the <br />applicant define or predict the cone of depression expected for any areas to be dewatered and dry <br />mined during the life of the operation. The cone of depression assessment should define, at a <br />minimum, the horizontal and vertical extent of drawdown expected. If during the assessmeht, the <br />applicant determines that a drawdown will occur offsite that may impact a current groundwater user, <br />the applicant should explain any mitigation measures to be implemented and trigger points that would <br />put mitigation measures into effect. <br />7. The operator has yet to address this concern noted in the Division's Mazch 13, 2006 letter. Please <br />address accordingly; <br />It appears that the Pazker/Dersham site is within the 100-year floodplain of the South Platte River. <br />Please provide the flood elevations(s) to be expected under a "worst case" flooding scenario and <br />specific mitigation measures that will be implemented to minimize the potential for any offsite <br />impacts. Legible copies of the Flood Insurance Rate Maps ("F1ItM") through the mine reach would <br />facilitate the Division's review. <br />8. The operator has yet to address this concern noted in the Division's Mazch 13, 2006 letter. Please <br />address accordingly; <br />Please explain how water from dewatering of the Parker/Dersham site will be managed to protect <br />against pollution of surface of groundwater both during and after the mining operation (Rule <br />6.4.7(2)(c))• <br />Because objections were filed with the Division, this matter must be set for a hearing before the Mined <br />Land Reclamation Board (NLRB). The tentative date for the hearing is June 14-15, 2006. However, the <br />Division will need to make a recommendation by May 12, 2006. Please be advised that Parker/Dersham <br />Resource application may be deemed inadequate, and the application may be recommended for denial on <br />May 12, 2006 unless the above mentioned adequacy review items are addressed to the satisfaction of the <br />Division. If you feel more time is needed to complete your reply, the Division can grant an extension to <br />the decision date. This will be done upon receipt of a written waiver of your right to a decision by May <br />12, 2006 and request for additional time (including a date for consideration before the NLRB).
