Cattany <br />Division DlleCtOr <br />Natural Resource Trustee <br />The Division received your adequacy response to the Division's March 13, 20061etter regazding the new <br />permit application for the PazkerfDersham Sand & Gravel Resource, File No. M-2006-003. The Division <br />has a number of remaining items that need to be addressed prior to approval of the application. <br />The Division was unable to locate the proof of notification for the following adjacent property <br />owners/structure owners: <br />o Jose Lujan (Pazcel 146936000030) <br />o Weld County (roads and property west of Dersham) <br />o Baseline RoadJl68`" Ave. (please state the owner of this road) <br />As required by Rule 1.6.2 (1)(g), please submit the proof ofpublication of the public notice for the <br />property/structure owners noted above. Proof of notice maybe return receipts of a Certified Mailing <br />or by proof of personal service. <br />2. The applicant provided certified mail receipts indicating that Bestway Concrete Batch Plant and Duke <br />Energy were notified of the application. Please locate these structures/landowners on the map. <br />3. Please provide the notarized letter from the Dershams consenting to remove/relocate structures within <br />the mining limits. As an alternative, the operator can provide adequate mining offset distances in <br />accordance with Rule 6.4.19. <br />4. The applicant states that topsoil will be replaced to the proposed high water line. Please indicate at <br />what elevation this will be within the reservoir. <br />5. Hall Irwin commits to replacing 10" of topsoil for all of Phases 1 and 2, for the perimeter of the water <br />storage reservoir in Phase 3 and as necessary in the landscape sales yazd. Please explain if the future <br />development area will receive topsoil prior to revegetation of the area. <br />6. The operator has yet to address this concern noted in the Division's March 13, 2006 letter. Please <br />address accordingly; <br />In accordance with Rule 3.1.6(1)(a), please explain how disturbance to the hydrologic balance will be <br />minimized during the mining and reclamation phase of the ParkerlDersham site. Please explain how <br />Hall-Irwin will be in compliance with Colorado Water Laws and regulations governing injury to <br />existing water rights.
