i) Construction activity will be prohibited within the critical wintering area <br />during the period when deer and elk are concentrated (usually December 1 to <br />r April 15). In light winters, this will not be necessary and the authorized <br />• officer may grant permission to work after consultation with [he Division of <br />Wildlife (DOW). This limitation of activity will minimize the disturbance <br />of big game. <br />j) Cutting of snags will be prohibited except those within the actual disturbed <br />area required for construction. This measure will minimize the loss of per- <br />ches and nesting trees for raptors, insectivorous birds and cavity nesters. <br />k) Reclamation efforts in all areas will be monitored periodically to determine <br />their adequacy in terms of both plant density and species composition. If <br />wildlife activity should prove to be an undue hindrance to revegetation, <br />fencing or other appropriate measures will be required until vegetation be- <br />comes established. <br />1) After initial construction is completed, activities other than on the mine <br />site itself and major access roads will be limited to the period frao sun- <br />rise to sunset between December 1 and April 15 except for emergency situa- <br />tions. <br />m) If the loss of available forage (as measured by DOW and BLM) exceeds 10 per- <br />cent, the applicant (CWI) will be required to carry out vegetative treatment <br />(or contribute funds) to increase forage on public lands within the critical <br />winter range area. <br />n) Public use of access roads and trails will be prohibited when big game are <br />concentrated in the winter (December 1 to April 16). <br />o) CWI will follow the list of plant species and seeding rates to be used dur- <br />ing site rehabilitation as submitted by letter dated 05/17/78. <br />p) All reclamation/refuse site activities will be in accordance with MESA stan- <br />dards. <br />~. <br /> <br />
