Sec. 30. MI1:ThG PLAK. In accordance w^th the regulations in 30 CFF _°11, 700, and 800, <br />the 1Cssee s'nali submit a Wining plan not more than three years after the effective `~ <br />date of this lease. Until the mining plan has been approved, the lessee shall not <br />conduct any operations on the leased lands except casual use or, ea-ploration if an ex- <br />p' tlon plan has been approved. Thereafter, the lessee shall conduct all operations <br />_ordance with the approved mining plan. <br />$E:~, 30. SPECIAL STIPULATIONS. In addition to observing [he general obligations and <br />standards of performance set out in the current regulations, the Lessee shall comply <br />with and be bound by the following special stipulations. These stipulations may be revised <br />or amended, in writing, by the mutual consent of the Lessor and the Lessee at any time <br />to adjust to changed conditions or to correct an oversight. The Lessor may amend these <br />stipulations at any time without consent of the Lessee in order to make ,them consistent <br />with any new Federal or State statutes and the regulations promulgated under authority <br />of the new statutes. <br />(a) The lessee shall utilize and operate all facilities and devices in accordance with <br />all applicable air quality standards and related plans of implementation adopted pursuant <br />to the Clean Alr Act (77 Stat. 392, as amended, 42 U.S.C. 7401) as nw in effect or as <br />hereafter amended, or if it should be superseded, the statute superseding it, and <br />applicable State standards. <br />(b) The lessee shall utilize and operate all facilities and devices in accordance with <br />State and Federal Statutes {including, but not limited to, the Federal Water Pollution <br />Control Act (62 Stat. 1155, as amended, 33 U.S.C. 1251-1376) and regulations as now in <br />effect or as hereafter amended, or Sf they should be superseded, the statute and regu- <br />lations superseding them. <br />(c) The lessee may not mine more than a total of 700,000 tons of coal per year from <br />th ~'D" seam described in this federal coal lease and in federal coal lease C-25079 <br />Wed. <br />• The lessee will make an inventory of the tract for significant palentologic re- <br />s~..__ces prior to the approval of the mining permit required by 30 CFR 710:11.
