<br /> <br />Rationale for Approval Recommendation Page 7 <br />Delta Paving Gravel Pit <br />File No. M-98-105 <br />April 7, 1999 <br />See response under item 4a above. The application indicates that topsoil is not available from <br />the Phase II area for reclamation purposes. Additionally, the applicant has indicated that <br />topsoil importation and replacement at the Phase II area may conflict with federal law, for <br />operations not permitted under a 404 permit. The applicant has committed to revegetation of <br />the Phase II area by transplanting Cottonwood tree and Willow tublings. The proposed <br />reclamation for the Phase II area supports the post mining land use and satisfies the <br />requirements of the Act and Rules. <br />Rule 3.1.10(6) requires that operators employ weed control methods for all prohibited noxious <br />weed species, and whenever invasion of a reclaimed area by other weed species seriously <br />threatens the continued development of the desired vegetation. Weed control methods shall <br />also be used whenever the inhabitation of the reclaimed area by weeds threaten further spread <br />of serious weed pests to nearby areas. <br />k. The proposed reclamation plan is not en adequate replacement for <br />the existing riparian wildlife habitat. Goal of reclamation p/an should <br />be the comp/ete restoration of wetlands habitat. IWSERCI <br />The reclamation plan, proposed in the application, satisfies the minimum requirements of the <br />Act and Rules. Additionally, Division of Wildlife comments, submitted as part of Exhibit H of <br />the application, indicate that the reclamation plan is appropriate to the site. <br />/. Reclamation p/an design team show/d inc/ude environments/ engineer, <br />biologist end ecologist trained in habitat rep/acemenf and should utilize <br />Confluence Park as a model /WSERC/ <br />See response under item 4k above. <br />m. Topsoil should be rep/aced at 8"-12" depth /Delta SCDI <br />The application commits to topsoil replacement at approximately 6" depth. Topsoil <br />replacement will occur for portions of the pond inslopes located above the expected water <br />line, and for portions of the stockpile area to be reclaimed to support wildlife habitat. The <br />materials immediately underlying the topsoil layer will consist primarily of alluvial materials, <br />rejected overburden and processing fines which appear capable of supporting vegetation. <br />Under such conditions, topsoil replacement at 6" depth is appropriate for the post mining land <br />use and satisfies the minimum requirements of the Act and Rules. <br />n. Reclamation seeding should occur per NRCS recommendations which inc/udes <br />Tall wheatgrass, Western wheafgrass, Crested wheatgrass, A/fa/fa, /ndian <br />ricegrass, Ga/letta, Ye/%w sweet c%ver, and fertilizer and mulch. /Delta SCD) <br />Revegetation mix proposed by the applicant consist of Sand dropseed, Blue grams, Indian <br />ricegrass, Galletta, Sainfoin, Cottonwood tree and Willow tublings, and fertilizer and mulch. <br />The revegetation mix proposed by the applicant appears capable of satisfying the performance <br />standards of Rule 3.1.10, and satisfies the minimum requirements of the Act and Rules. <br />
