The Board and DMG will review all comments, submitted in accordance with the Act <br />and Rules, in its review process. <br />f. Affected river banks show/d be revegetated with native <br />vegetation plugs /WSERC/ <br />The application does not indicate that the river banks will be affected by mining operations. <br />The applicant has committed to maintaining a 100' setback from the river bank. <br />g. 3h1:1 V pond inslopes are not eccepiab/e, pond inslopes should <br />provide sha//ow and deep water habitat /WSERCI <br />Rule 3.1.5(7) specifies that pond inslopes shall be no steeper than 2H:1 V, except from 5' <br />above to 10' below the expected water line where slopes shall be not steeper than 3H:1 V. <br />Additionally, DMG has received agency comments from the Delta County Mosquito District <br />indicating that shallow water habitat, with emergent vegetation, provide breeding habitat for <br />mosquitos and therefore should be avoided. The applicant's commitment to 3H:1 V pond <br />inslopes is a permit condition and demonstrates compliance with the Act and Rules. <br />h. Pond design should approximate 3H:1 V inslopes, ensure fresh water <br />supp/y end water movement, and that emergent vegetation and <br />vegetation 6'-10' above the water line show/d be discouraged <br />to retard mosquito breeding activity (Delta Mosquito District) <br />The application indicates that pond inslopes will approximate 3H:1 V and that ponds are <br />groundwater fed. The applicant has responded that pond inslopes above the expected water <br />line will be stabilized with vegetative cover, in accordance with the Act and Rules. <br />i. Revegetetion seed mix, consisting of dry/and grasses, is inappropriate for <br />riparian areas where sedges, rushes and cattails should be planted /WSERCI <br />The reclamation seed mix recommended by the Delta Soil Conservation District also consists <br />of dryland grasses and is similar to the seed mix proposed by the applicant. The revegetation <br />mix proposed by the applicant is composed of native warm and cool season grasses, provides <br />a nitrogen fixing legume species, and includes Cottonwood tree and Willow tublings <br />transplants. The proposed revegetation mix supports the post mining land use and satisfies <br />the requirements of the Act and Rules. Cattails are regarded by some wetlands specialist as <br />an undesirable invasive species for riparian areas. <br />j. Proposed reclamation for the Phase // area does not appropriate/y address <br />revegetation and is not acceptable, affected lands maybe infested by <br />noxious weeds end undesirab/e non-native species /WSERCI <br />
