Permit documentation indicates <br />that the applicant has committed to complying with recommendations from wildlife agencies. <br />g. Ciitica/ riparian habitat shoo/d be excluded /rom the permit boundary /WSERCI <br />The Act and Rules do not exclude mining activities from riparian areas, except to the extent <br />that such areas are located on lands covered under Section 34-32.5-115(4)(f) C.R.S. The Act <br />and Rules provide reclamation requirements to ensure that affected lands are reclaimed to a <br />beneficial land use. The Colorado Division of Wildlife (DOW) has reviewed the application and <br />has indicated that measurable impacts to wildlife, resulting from the proposed operation, will <br />be reduced or eliminated due to the method of mining and reclamation proposed in the <br />application. <br />h. Arees 2, 4 end 7 ere located in riparian areas, near wetlands /Shepardl <br />See response under item 3g above. <br />/. Mining should not be a/lowed at Area 3, near the river (Shepardl <br />See response under item 3g above, and 3j below. <br />j. Arees 2, 4, 7 and the p/ant is located in floodplain rated Zone A4 /Shepardl <br />The Act and Rules do not exclude mining activities from floodplain areas, except to the extent <br />that such areas are located on lands covered under Section 34-32.5-115(4)(f) C.R.S. The <br />application indicates that the processing plant is located within the 100-year floodplain. The <br />application indicates that fuels, lubricants and other potentially hazardous contaminates <br />utilized on-site will be stored in accordance with the materials containment plan of the <br />Stormwater Permit, required by the Water Quality Control Division with the Colorado <br />Department of Public Health and Environment. Additionally, the application indicates that <br />storage areas will be protected from potential flooding by locating storage areas above the <br />100-year floodplain, or by diversion berms, or by removal of the potentially hazardous <br />contaminates from the area during times of elevated flood potential. The application <br />demonstrates compliance with the performance standards of Rule 3.1, and indicates that <br />operations will be conducted in a manner which minimizes disturbances to the prevailing <br />hydrologic balance of the affected land and of the surrounding area and to the quantity or <br />quality of water in surface and groundwater systems both during and after the mining <br />operation and during reclamation, as required by Rule 3.1.6. <br />k. Food potential aggravated by activities proposed by Bureau of Reclamation <br />and/or the National Park Service (Delta County Commissioner, Shepard, WSERCI <br />See response under item 3j above. Additionally, the status of the potential activities proposed <br />by the National Park Service and/or Bureau of Reclamation, to release water from upstream <br />reservoirs, is undetermined at this time.
