is given to the owner or occupant ofthe property on which the system is located and at which <br />the owner or occupant may be present, with counsel, and be heazd. The order shall require <br />that the owner or occupant bring the system into compliance or eliminate the health hazard <br />within a reasonable period of time, not to exceed thirty (30} days, or thereafter cease and <br />desist from the use of the system. A cease and desist order issued by the health officer or <br />his/her designated representative shall be reviewable in the district court for the county <br />wherein the system is located an upon a petition filed not later than ten { 10) days after the <br />order is issued. <br />3.13 Operation, inspection, Maintenance and Testing of Systems <br />A. The property owner shall be responsible for proper operation, maintenance, and <br />cleaning of the system and abatement of any nuisance arising from it's failure, utiless <br />jurisdiction for responsibility has been transferred to a public, quasi-public, or private <br />entity or political subdivision. <br />B.
