The <br />initial fee for a System Cleaner license shall be paid to the local health department at <br />the time the License application is submitted. Licenses shall expire on December 3 ] <br />of each year, and an annual renews] fee shall be paid to the local health department. <br />A license which lapses because of farure to renew or is revoked shall be subject to the <br />fee established for new licenses upon re-application. <br />B. A Systems Cleaner License may be revoked for failure to comply with these <br />regulations. Written notice of a proposed license revocation, particularizing the <br />violations of these regulations, shall be served by the local department of health upon <br />the holder of the Systems Contractor License by certified mail, return receipt <br />requested. Revocation shall take place only after a hearing before the local board of <br />health. The license holder shall be given not less than ten (10) days notice of the <br />hearing and may be represented at the hearing by council. <br />C. All Systems Cleaners shall be required to dispose of septic tank wastes at a site <br />approved by the local health department for accepting or treating such wastes and in <br />a manner that is not injurious to public health. <br />3.09 General Prohibitions <br />A No individual sewage disposal system which fails to comply with the provisions of <br />these regulations regarding minimum separation between the maximum seasonal level <br />of the ground water table and the bottom of an absorption system shall be permitted <br />to remain in use after October 1, 1975. <br />B. Use, construction, and/or existence of cesspools, non-vaulted privies, flush hopper <br />toilets is prohibited. <br />C. Not more than one (1) dwelling or one (1) commercial, business, institutional, or <br />industrial unit shall be connected to the same individual sewage disposal system unless <br />such multiple connection was speciSed in the application submitted and in the permit <br />issued for the system. In the event an application requests more than one (1) dwelling <br />or one (1) commercial, business, institutional or industrial umt to be connected to the <br />same individual sewage disposal system, prior to the issuance of a permit, the <br />applicant shall submit and record with the Clerk and Recorder a suitable conversant <br />that is satisfactory to the local health department and which describes the <br />arrangements governing joint use of and responsibility for repair and maintenance of <br />the system. <br />D. No person shall construct or maintain any dwelling or other occupied structure which <br />is not equipped with adequate facilities for the sanitary disposal of sewage. <br />E. No person shall allow sewage or a®uent to be discharged on the surface of the <br />ground or imo waters of the State, unless the sewage or effiuent meets the minimum <br />requirements of these regulations or the water quality standards of the Colorado <br />Water Quality Control Commission. <br />20 <br />
