M-87-113, Adequacy Response. <br />On behalf of our client Church Ranch, we will respond to your <br />adequacy letter questions in the same format as they were asked. <br />Proof of Publication will be sent to you under separate cover once <br />we receive it from the paper. <br />1. Szbibit C- liffected Land - The Church Pit is leased to Lakewood <br />Brick by the Church Ranch. The line that you refer to is the <br />200 foot line required in CRS 34-32-112(4)(e), rule 2.12.3b. <br />2. The document you request is attached. <br />3. We agree with this assessment and will commit to a setback of <br />at least 50 feet from the ditches. I believe this is the <br />distance I used on all of the Map Exhibits. McKays have been <br />working with the City of Broomfield to relocate the ditches <br />within the area shown as possible a new ditch easement on Map <br />Exhibit C. If this happens the design call for the mining <br />setback to again be more that 50 feet. <br />4. Good recommendation, but we prefer to leave the slopes at 2h <br />to lv to maximize the removal of material from the site. The <br />material is a very tight material and holds slopes very well. <br />Evidence of this is the slopes on the overburden stockpiles <br />located east and west of the current clay excavation. The <br />side slopes on these piles show very little change erosion or <br />change during the 3 to 5 years they have been in place. By <br />
