The 45 acre portion 1s a small part of the total 321 acres <br />owned by the applicant. The material will be exported from the site and used >n foundation <br />bacld'il] projects. and County or State Highway projects $t the area. The possibility also <br />exists that the material could be used for construction related activities at the New <br />International Airport as well as for the Front Range Airport. Reclamation of the site Is <br />designed to be as a large dry pit In the Bijou Creek drainage. G er p - ~ . <br />Plauning Commission Update: <br />New Information: The applicant presented new information to staff with a request for <br />extended hours of operation beyond the 10:00 pm limit as recommended by staff. The <br />Planning Commission discussed khis proposal and granted the applicants the ability to <br />request extended hours at the discretion of the Director of Planr>irtg and Development. If <br />warranted. any Such requests could be taken to the Board of Commissions for a public <br />hearing. This change >n conditions of approval appears under Stipulation number 7, below. <br />Citizen Comments: None <br />FIlYDINGS OF FACT: <br />1. The applicant Ls proposing to mine a portion of his property that ]ses within the 100 year <br />floodplain of West Bijou Creek. The property has been previously mined on a small scale. <br />sometime In the past, without a permit. <br />2. 1f the applicant can abide by the conditions recommended by the Public Works <br />Departrnent, and obtains all permits associated with floodplain use, stormwater discharge, <br />and fugitive dust, the project would be considered compatible with the surrounding area. <br />3. The applicant's site Ls located in a sparsely populated area of the County and is very rural <br />in character. Amine of this type, if operated and reclaimed as proposed, would be <br />compatible with the Zoning Regulations and the Comprehensive Plan. <br />4. Information concerning approved minlrtg and reclamation plans from the Mined Land <br />Reclamation Division, and well permits from the DSvLslon of Water Resources, is required <br />prior to the start of mining, and prior to washLng any material. If these pernuts are- <br />obtalned, the proposal would be compatible with the Adams County Zoning Regulations. <br />5. If the applicant can operate within the proposed mining and reclamation plans, as <br />revised, the project would not be detrimental to the health. safety. and welfare of the <br />L-iltabitants of the area, nor would it deter future quality development of the area. <br />COUNTY COMIVIISSIONER HEARING JULY 2Q. 1992 <br />
