Box 94 <br />Silverton, Colorado 81933 <br />RE: Preliminary Adequacy Review <br />Our File 1182-11, "!lillyer Pit" <br />Dear Mr. Hillyer: <br />Z have completed my initial review of the application you submitted For a <br />mining and reclamation permit and I find that it does not adequately <br />consider the potential impact to the prevailing hydrologic balance of the <br />Animas River (both surface and alluvial groundwater systems). <br />2 have listed below the information I believe will be necessary for you to <br />supply before we can complete our review and make a recommendation to the <br />TSi ned Land Reclamation Board. <br />1) Exhibits B & C, Mining Plan and Map <br />„,;tt 6. I.akd <br />The specific area in which the proposed operation^has not been <br />identified such that its relation to the active reiver channel can be <br />considered. The river channel and the boundary of your S acre area must <br />be shown on a map. The development of the mining operation must be <br />illustrated (i.e. delineate phases on map and describe extraction scheme). <br />2) Exhibit D, Water Resources <br />It is our expectation that any "gravel farming" operation developed <br />in the main channel of an active river will directly affect the prevailing <br />hydrologic balance of that river. Now much aggregate do you propose to <br />remove from the river channel on an annual basis? Approximately what <br />fraction of the river's annual sediment load will this represent? 7low <br />many years do you expect to continue this extraction? The extent to which <br />your mining operation might cause a lowering or lateral relocation of the <br />river channel should be discussed. Are there bridges, dams, irrigation <br />ditch headgates, or other structures within one (1) mile upstream or down- <br />stream which might be affected? Do you have water rights to cover the <br />beneficial and consumptive uses involved in the proposed operation? (Note <br />that the State Engineer has been considering evaporative losses as a <br />consumptive use.) Have you applied to the Colorado Department of Health <br />for a NPDES permit? Fugitive Dust permit? <br />
