' „~ ~ T 1'crmit Ho. 74-111 <br />l 1~ ~. - <br />~ ,~I ~/,/ ~ LAND RECI~Ai V,'1'IOP7 BOARII <br />S ~ l 1VI o ~ Department of IJatural Resource;. <br />~ Room 114, lf3lFS Sherman Street Telephone: 892-3403 <br />Denver, Colorado (30203 <br />OPE:; Ii; F:).;:G PERh1IT <br />'ll{IS FL•R1~iI'1' is issued this 14th day of October , 1976 <br />by the Land Reclamation Board, Department of Natural Resources, State of Colorado. <br />41 I T N E S S E T 1{ <br />?•JIIERIiAS, SCHMIDT CONSTRUCTION, INC. <br />desires to operate an open mine, known as Th .h 's ,an it , for the purpose of <br />extracting Sand and Gravel and, <br />?IIQs'ItI:AS, the Land Reclamation Board has received an application and <br />reclamation plan and map, a fee and a bond or security for such operation as <br />required by law: and, <br />' FI1tERE.'tS, the Land Reclamation Board has made a finding, for the purposes <br />of issuing this permit, that the method of operation, pt~sicai appearance, and <br />timetable are reasonable in vied of the public interest in physically attractive <br />surroundings and completion of the operation as soon as practicable; and, <br />iJI~REAS, for the purposes of issuing this permit, the operator has made <br />a satisfactory showing to the Board that his operation will not adversely affect <br />the stability of arty man-made structure on the area of the affected land and <br />within two hundred feet of all boundaries of such area; and, <br /> <br />IJIfI;REAS, fo.r the purposes of issuing this permit, the operator has made <br />a satisfactory showing to the Board that he will employ during and after his open <br />mining operations procedures reasonably designed to minimize as much as practicable <br />the disruption from the open mining operations and will provide for the z•eltabilita- <br />tion of any such surface resources adversely affected by such open mininn operations <br />through the rehabilitation of plant cover, soil stability, water resources, and other <br />measures appropriate to the sub sequential beneficial use of such mined and reclaimed <br />lands; and that in the event of the failure of his proposed reclamation plan, he <br />will take whatever measures which may be necessary in order to assure the success <br />of reclamation of the lands affected by his open mining operations; and, <br />1dHEREAS, for the purposes of issuing this permit, a copy of the applica- <br />tion approved by the Land Reclamation Board of the State of Colorado is attached <br />to this permit and thereby becomes a part of the terms hereof. <br />PION T1~REFORE, Pursuant to the authority set forth in the Colorado Open <br />tdining Land Reclamation Act, Article 32 of Title 34, C.R.S. 1973, as amended, the <br />Land Reclamation Board of the State of Colorado hereby issues a permit to <br />SCHMIDT CONSTRUCTION, INC. to engage in open mining for the purpose <br />of extracting sand and gravel on the following parcel of ground:. <br />Portions of Section 12 & Section 13, Township 16 South, Range 66 West, E1 Paso <br />County, as indicated on Reclamation Bond, Number 19-0130-2388, <br />This permit is issued subject to all requirements of the Colorado Open hlinin„ Land <br />Reclamation Act and all rules, regulations and ^,tandarcls now in force and any which <br />may in the future be provnilgated by the Land Reclamation I;oard, and this permit may <br />be revoked or suspended for non-compliance with such rules, regulations and standards <br />Chairman, Land Reclamation Board <br />This permit is valid until June 30, 19_. <br />v <br />
