-, _ ~ iss <br />Permit No. 741 <br />MINED LAND RECLAMATION BOARD • <br />Department of Natural Resources III III III IIIIIIIIII <br />Room 723, 1313 Sherman Street 999 <br />Denver, Colorado 80203 Leiepnune: 892-3567 <br />OPEN MINING PERMIT <br />THIS PERMIT is issued this 14th day of October, 1976 by the Mined Land <br />Reclamation Board, Department of Natural Resources, State of Colorado. <br />W I T N E S S E T H <br />WHEREAS, SCHMIDT CONSTRUCTION, INC. desires to operate an open mine, known <br />as The Christian Pit, for the purpose of extracting Sand'and Gravel; and, <br />WHEREAS, the Mined Land Reclamation Board has received an application and <br />reclamation plan and map, a fee and a bond or security For such operation as <br />required by law; and, <br />WHEREAS, the Mined Land Reclamation Board has made a finding, for the purposes <br />of issuing this permit, that the method of operation, physical appearance, and time- <br />table are reasonable in view of the public interest in physically attractive <br />surroundings and completion of the operation as soon as practicable; and, <br />WHEREAS, for the purposes of issuing this permit, the operator has made a <br />satisfactory showing to the Board that his operation will net adversely affect the <br />stability of any man-made structure on the area of the affected land and within tcoo <br />hundred feet of all boundaries of such area; and, <br />WHEREAS, for the purposes of issuing this permit, the operator has made a <br />satisfactory showing to the Board that he will employ during and after his open <br />mining operations procedures reasonably designed to minimize as much as practicable <br />the disruption from the open mining operations and will provide for the rehabilitation <br />of any such surface resources adversely affected by such open mining operations <br />through the rehabilitation of plant cover, soil stability, water resources, and other <br />measures appropriate to the subsequential beneficial use of such mined and reclaimed <br />lands; and tf~at in the event of the failure of his proposed reclamation plan, he will <br />take whatever measures which may be necessary in order to assure the success of reclama- <br />tion of the lands affected by his open mining operations; and, <br />W}1EREA5, for the purposes of issuing this permit, a copy of the application <br />approved by the Mined Land Reclamation Board of the State of Colorado is attached to <br />this permit and thereby becomes a part of the terms hereof. <br />NOW THEREFORE, Fursuant to the authority set forth in the Colorado Open <br />Alining Land Reclamation Act, Article 32 of Title 34, C.R.S. 1973, as amended, the <br />Mined Land Reclamation Board of the State of Colorado hereby issues a permit ~~! <br />SCHMIDT CONSTRUCTION, INC. to engage in open mining for the purpose of extracting <br />sand and gravel on the following parcel of ground: SW's SE`s of Section 12; Wi W=;: NEB and <br />W~ ld'~ SEA of Section 13; Plus that portion of the NW's of Section 13 described as <br />follows; Beginning at the NE Corner of the NW4 of Section 13, the true point of <br />beginning; thence South a distance of 1800 feet; thence West a distance of 968 feet; <br />thence North a distance of 1800 feet; thence East a distance of 968 feet, returning <br />to the point of beginning, containing 40.0 acres more or less.
