REVISED EXHIBIT "E" <br /> Exhibit "E" of the initial Reclamation Application is herein revised <br /> to reflect the following: <br /> A. The slopes in the reclaimed area, 3.26 acres above the water <br /> and the additional 2.5 acres below the water will be sloped as stated In <br /> Paragraph 1 of the Initial Reclamation Exhibit and will be disced parallel <br /> to the slope base of the pond to minimize erosion problems. <br /> B. The seed mix, as stated in Paragraph 1 of the initial Exhibit <br /> "E" to this application, is amended to show that the seed mix would <br /> include blue grama, sand, drop seed and side oat grama, replacing wild <br /> rye and pubescent wheat grass In the same quantities. <br /> C. After relayering and sloping of the area to be reclaimed has <br /> been effected, but prior to reseeding, it will be tested to determine If <br /> soil additives or fertilizers are necessary, which as necessary will be <br /> added to support the revegetative mix set forth above. <br /> D. The relayering of the overburden, sloping and revegetative mix <br /> with the supplementation of the soil , If necessary, in Sector A will be <br /> effected upon cessation of mining in Parcel A no later than one ( 1 ) year <br /> after the cessation of mining in Parcel A. After cessation of mining in <br /> Parcel B, the relayering of overburden, sloping, soil supplementation <br /> and revegetative mix will be planted no later than six (6) months after <br /> cessation of mining within Parcel B. <br /> E. The stockpiles, as referenced in Exhibit "D", of course, will <br /> be reduced and used for the relayering and sloping of the perimeter, the <br /> reclamation of 3.26 acres above the water and 2.5 acres below. THUS, <br /> 5.75 ACRES WILL BE THE TOTAL AMOUNT OF OVERBURDEN AND TOPSOIL REPLACED <br /> WHICH IT IS ESTIMATED WILL BE REMOVED TO PERMIT MINING. <br /> F. It is explicitly understood that reclamation of the perimeter, <br /> leaving a net pool of water of 10 acres in Parcel A and a net pool of <br /> water of .9 acres of water in Parcel B, according to Exhibits "D" and <br /> "E", i .e. the proper sloping, relayering of overburden and topsoil , the <br /> soil supplementation and revegetation, given the proper slopes as stated <br /> therein, is the responsibility of the permit holder only and that bond <br /> will not be released until this relcama'fion is completed. This reclamation, <br /> as herein set forth, was the minimal reclamation in the Initial application. <br /> The operator still will be responsible for that minimal reclamation and <br /> should there be additional clean fill materials because they exist on <br /> the property, which would result in the fill of a significantly larger <br /> area than stated herein (which Is not expected) , the operator would <br /> appear before the Board for a technical revision of this Reclamation <br /> Plan. <br /> Further, should the owner be able to obtain clean fill to cover the <br /> standing pond of water or a significant part of the pool of water not;a <br /> part of this permit, then it is understood that this is the landowner's <br /> responsibility and that he may appear before the Board for a technical <br /> revision to permit the fill and reclamation in whole or in part the <br /> standing pools of water to be left when the operator ceases his operation <br /> and reclamation. The owner understands that: <br /> A. Any permits from the County for clean fill material deposit <br /> would have to be procured; <br /> B. Approval would be necessary by the Colorado Mined Land Reclamation <br /> Board; <br /> C. That the type of material would have to be analyzed in terms <br /> of any possible pollution of the water or water table by siltation or <br /> toxicity; and <br /> REVISED EXHIBIT "E" - Reclamation Plan <br /> Page 1 <br />
