REVISED EXHIBIT "D" <br /> The previous Mining Plan, Exhibit "D", is hereby amended to reflect <br /> that at the cessation of the mining operation a standing pool of water <br /> will remain. In Parcel A there will be a standing pool of water as seen <br /> on Exhibit "F", Reclamation Plan Map, which will be a ten ( 10) acre lake <br /> and the area around the perimeter, subject to reclamation, will be 2.46 <br /> acres. With regard to Parcel B, again reference is made to Exhibit "F", <br /> the Reclamation Plan Map, as a standing pond of water of .9 acres will <br /> remain at the cessation of mining and .8 acres approximately will be <br /> subject to reclamation; that being the perimeter of the property line. <br /> Thus, the total amount of land subject to reclamation would be 3.26 <br /> acres and the total of the standing water would be 10.9 acres ( 10 acres <br /> In Parcel A and .9 acres in Parcel B) . Although 3.26 acres will be <br /> above the water table, giving consideration to the slope requirement <br /> will result In 2.5 acres of material below the water table (2.0 acres in <br /> Parcel A and .5 acres in Parcel B) . <br /> The initial Exhibit "D" makes reference to additional reclaimed <br /> areas, but if the operator would have clean fill to be placed to fill <br /> the water or the landowner would have the same, then the operator or <br /> owner is expressly aware: <br /> A. That the County authorities would require a Clean Fill Permit . <br /> B. The questions of what type of fill and whether this would <br /> create a possible hazard of pollution or contamination of the water <br /> tables, needs to be addressed. <br /> C. Any further fill over and above what is described immediately <br /> above would require a technical revision. <br /> Because the perimeter only will be reclaimed, the overburden and <br /> topsoil removed will be sufficient to relayer and reslope the perimeter <br /> and revegetate the same according to Exhibit "E" and to the extent set <br /> forth above, 3.26 acres being reclaimed around the perimeter above the <br /> water. Because the overburden and topsoil is going to be relayered and <br /> placed in the water and this material is the same that will have been <br /> removed from the site, this is clean fill material and that same material <br /> removed is being replaced. Further, this overburden and topsoil will <br /> not produce any ground water contamination either through siltation or <br /> toxic substances. <br /> A permit is not required to use that portion of Colorado Boulevard <br /> which is not a public road as this has been vacated to the use of the <br /> landowner, William V. and Dona Mae Bromley, and the lease arrangments <br /> set forth in Exhibit "N" permit the operator to use all existing access <br /> roads which would include this vacated portion of Colorado Boulevard. <br /> We are in the process of acquiring permission to use the existing <br /> gravel access road to mine Parcel B (Sector 3 of the Reclamation Map) , a <br /> small section of 1 .67 acres, and either permission will be evidenced to <br /> the Board at the October, 1979, meeting or we would propose to delete <br /> this sector from any operation at this time and reappear before the <br /> Board on a technical revision to add this sector when permission is <br /> acquired. <br /> REVISED EXHIBIT "D" - Mining Plan <br /> Page 1 <br />
