• 15. Discharged dredged material shall not consist oP unsuitable <br />material [e.g., trash, debris, bituminous concrete (asphalt), car <br />bodies, etc.] and must be Pree from toxic pollutants in toxic <br />amounts. <br />16. A discharge of material may not occur in the proximity of a <br />public water supply unless appropriate approval is given and <br />mitigation measures are identified to offset any adverse effects. <br />17. This permit does not obviate the need to obtain other <br />Federal, state or local authorizations as required by law, does <br />not grant any property rights or exclusive privileges, does sot <br />authorize any injury to the property rights of others, and does <br />not authorize interference with any existing or proposed Federal <br />project. <br />18. In issuing this permit and giving approval to perform work <br />under this permit, the Federal Government does not assume any <br />liability Por damages to the permitted project, or uses thereof, <br />' as a result of current or future activities undertaken by or on <br />behalf of the IInited States in the public interest; damages to <br />persons, property, or to other permitted or unpermitted. <br />activities or structures caused by the activity authorized by <br />this permit; design or construction deficiencies associated with <br />the permitted work; or damage claims associated with any future <br />• modification, suspension, or revocation of this permit. <br />19. You must allow representatives from the Corps of Engineers <br />to inspect the authorized activity at any time deemed necessary <br />to ensure that it is being or has been accomplished in accordance <br />with the terms and conditions of this. permit. <br />20. The Corps oP Engineers may re-evaluate its decision on any <br />authorization given in accordance with this permit at any time <br />that circumstances may warrant. Circumstances that could require <br />a re-evaluation include, but are not limited to,,.:the following: <br />a. You tail to comply with the terms and conditions of <br />the permit; <br />b. The information provided by you in support of your <br />application proves to be Palse, incomplete, or inaccurate; <br />and <br />c. Significant new information surfaces which the <br />Corps oP Engineers did not consider in reaching a decision. <br />• <br />8 <br />
