If the Corps of Engineers does DQ~ need to <br />coordinate your proposal with other Federal or state agencies, <br />the Corps of Engineers may respond earlier to your request. If <br />formal consultation with the U.S. Fish and Wildlife Service (FWS) <br />on the effects of your project to threatened and endangered <br />species, or their critical habitat, is necessary, then a decision <br />by the Corps of Engineers will be delayed until the consultation <br />is completed and the FWS renders a Biological Opinion. If your <br />request is rejected, you may apply for an individual Department <br />of the Army permit. ' <br />You may not proaead rich your projaot until aotifiad by the <br />• Corps o! Engineers. If you proceed without approval from the <br />Corps of Engineers, you may ba subject to severe penalties under <br />the law. <br />9COPB OF IIOREt Under Section 404 of the Clean Water Act, <br />the Corps of Engineers regulates the discharge oP dredged <br />material and fill material in waters of the United States. As <br />defined by regulation, the discharge of dredged material includes <br />the addition of material incidental to dredging and excavation in <br />waters of the United States. Under Section 10 of the Rivers and <br />Harbors Act, the Corps oP Engineers regulates various work in <br />navigable waters of the United States. The Corps of Engineers <br />has the authority to issue regional general permits Por <br />activities that are substantially similar in nature and cause <br />only minimal individual and cumulative environmental impacts. <br />This RGP covers the discharge of dredged material associated with <br />minor. dredging/excavation projects in waters of the United States <br />within Colorado which have minimal environmental effects.
