to be mined and the area of other affected lands. The current map does not establish those azeas
that will be mined or affected by such actions as roads, topsoil piles, stockpiles, processing
facilities, or other facilities. Also see the definition for "affected land" in Rule 1.1(3).
3. There are two pre-permit mining azeas in the proposed site. Please describe the extent and location
of these sites. Only one of the pre-permit sites was noted in the revised map
6.4.4 EXHIBIT D - Minine Plan
1. Your response states that he landowner wants to the Applicant to remove the two water structures
located on the site. Please provide a letter from the landowner stating that the structures are to be
removed by the applicant.
2. The answer provided did not provide sufficient detail in addressing the adequacy issue listed
below. Please revise your response to address the following adequacy issues.
There are possibly as many as five ephemeral watercourses in the draws that run through the site.
Provide a description of how these watercourses will be dealt with during mining. Specifically, if
protection of these draws and associated watercourses is needed, how will the Applicant avoid
these azeas during mining? Provide details on any practices and erosion control structures that will
be needed to avoid impacting these watercourses?
3. The answer provided did not provide sufficient detail in addressing the adequacy issues listed
below. Please revise your response to address the following adequacy issues.
Please be more specific about the type, extent, location, and timing for the erosion control features.
Will any water quality or storm water detention ponds or other structural measures be required?
Please provide a plan showing how water runoff from disturbed areas, piled materials, and
operating surfaces will be managed to protect against pollution of either surface or groundwater
both during and after the operation. Please provide a description of any structures or practices that
will be required by the Water Quality Control Division stormwater permit. In your May 6, 2005
NRCS attachment the Conservationist states that water erosion will be a problem. He further
states that water control will be an issue, and that flooding from the site during rain events will
cause damage to cropland. The goal is to ensure that there is not any offsite damage from
stormwater flows (Rule 3.1.6).
6.4.5 EXHIBIT E -Reclamation Plan
This section is adequate as submitted.
6.4.6 EXHBIT F -Reclamation Plan Map
A new Reclamation Plan map was not submitted with the Applicant response to the adequacy
comments. Please provide a revised Reclamation Plan Map that addresses the adequacy concerns
listed below, and follows the requirements of section 6.4.6.
1. The map submitted does not meet the requirements described in Rule 6.4.6. Please provide at a
minimum the following items:
a. The expected physical appeazance of the azea of the affected land, correlated to the
proposed mining and reclamation timetables.
b. The map must show proposed topography of the area with contour lines of sufficient detail
to portray the direction and rate of slope of all reclaimed lands; and
c. Portrayal of the proposed final land use for each portion of the affected lands.
